A 5-year-old boy was killed early Tuesday, July 19, 2011, when a Canadian logging truck crashed into his home on Main Street in Jackman, according to police.

JACKMAN, Maine — No charges have yet been filed against a Canadian driver who fell asleep at the wheel and crashed his tractor-trailer loaded with logs against a house on U.S. Route 201, killing a 5-year-old boy asleep on a couch.

Somerset County District Attorney Everett Fowle said Wednesday the case still is under investigation.

Liam Mahaney was killed early Tuesday morning when the tractor-trailer spilled its load of tree-length logs into the house, causing the second floor to collapse onto the first floor, according to Lt. Carl Gottardi II of the Somerset County Sheriff’s Department.

Driver Christian Cloutier, 57, of Quebec, who told police that he fell asleep, struck two utility poles before his vehicle flipped onto its side and against the house rented by Gary and Christine Mahaney and another family, according to Gottardi. Cloutier was taken by ambulance to the Jackman Health Center after the accident and then transferred to Eastern Maine Medical Center in Bangor. Cloutier was listed in fair condition Wednesday, a nursing supervisor said.

The other five occupants of the house were taken to the Jackman Health Center for treatment and all but one was released on Tuesday. The child’s mother, Christine Mahaney, was taken to Redington-Fairview General Hospital in Skowhegan with injuries that were not life-threatening, according to Gottardi. A nursing supervisor said she had no comment Wednesday on Mahaney’s condition.

The 2011 Peterbilt truck and trailer owned by D.A.N. Express of Quebec was heavily damaged and was impounded for further inspection.

Friends have started a benefit fund to help the Mahaney family. Donations can be forwarded

to the Mahaney Benefit Fund, Skowhegan Savings Bank, P.O. Box 141, Jackman 04945.

    I think charges of negligence should be brought against a Canadian company employing Canadian driver endangering Maine children like this.  Sorry, but I feel this way.  My thoughts and prayers to the Mahaney family for their terrible loss.

    Oh, man.  This might be an even freakier freak accident than the thunderstorm tree branch impalement a couple weeks ago.  At least when you’re out driving you have a reasonable expectation that what you’re doing might be a little dangerous.  Having a nap on the couch, not so much.

    Looks like the house is pretty well totaled, too.  I’m sure that’s low on the family’s priority list at the moment, but… jeez.  I hope that trucking company has good insurance.

    Another ignorant logging truck driver driving too fast in the middle of the night. Why? Because that’s what these nuts do. …… Drive as fast as they can with unsafe loads and end up killing innocent people………..seems like it happens once a week.

    They’ve already leveled what was left of the house.  I’m just amazed that the rest of the family survived.  There were others on the first floor.

    Mister, this truck driver fell asleep on the road, hauling a dangerous load of tons of logs.  Now I would like to believe that most truck drivers have the sense to pull of to the side and get some sleep if they feel that they cannot drive safely.  This is the responsiblity of the truck driver so that they won’t endanger people.

    yea i  understand he was hauling wood etc, yes he should of pulled over and taken a nap, but he might not have been tired when he left border, between the border and jackman there is maybe 2 spots for a truck to safely get off the road to take a nap until you get into town, we as the public dont know what his intentions were, all we know is he fell asleep, there may have been a spot in town he was trying to get to so he could pull over and nap and didnt make it there… its all speculation with you guys, its a tragic “Accident” the driver didnt “Intentionally” do this, should charges be filed against him i dont know, its not up to me to decide, i am a truck driver and i haul wood, I would want to blame to driver if this was my child, but i would also know that he didnt intentionally do this, jail time isnt going to bring their son back nor is it gonna give them justice, the driver already has a life sentence of knowing he killed an innocent boy, i doubt you have to worry about him driving again with something like this on his conscience

    I think everyone is stereotyping on both sides of this truckers and non-truckers.  There are many truckers that dont give two snaps about the cars on the road.  I have been run on the road in a snowstorm by a truck with my two little kids in the car because he was passing me and another rig in an unsafe zone, it is a very good thing someone else was driving because if I had been we would’ve all been dead.  He pulled in to avoid a head on collision with another tractor trailer and he wasn’t even past us.  Not even close.  I have also almost been rear ended by a truck who wasn’t paying attention to my blinker for the 1000 ft I had it on.  He thought he was going to go around me which would have never happened and in that case the oncoming vehicle saw what was about to happen and stopped so I could get into the oncoming lane so the truck didn’t hit me.  So don’t act like all trucks are worried about other drivers, they are not.  I am very courteous to trucks.  The problem is that nowadays there are too many people in general on the road that are tired, are on prescription medications, or are just bad drivers.  One would think though if the vehicle was actually traveling at the posted speed this type of accident would have been much less likely to happen.

    I agree there are absolutely times that a truck driver may be at fault.  It does go both ways, but it is hard knowing how hard some drivers work to make a living to see the trucker always get blamed.  As soon as there is an accident involving a tractor trailer, everyone automatically assumes it was the trucker’s fault.  Most truckers I know aren’t talking on their phones, texting while driving, eating while driving and all the things that people in cars do all the time.  I remember my Dad telling me about how he actually gets more tired driving a car because when he is in his truck he has so many more things he has to pay attention to and it keeps him more alert.

I don’t know the family and the forms from EXTREME HOME MAKEOVER want a lot of information on the family I don’t have.     to all of you arguing about this : SERIOUSLY??? i am from jackman and everyone is trying to help the Mahaney family as much as we can in this time and arguing on here back and forth is NOT helping. Stereotyping truck drivers is not the answer either, most in jackman do speed at 2am. cant tell me different ive seen it. but that doesnt mean they all do. this was a tragic accident that happened and should be treated as such, not as an excuse to insult each other.

    Not bashing truckers…it’s all about making $$$ for the big corporations pushing for more production as well as hiring untrained drivers. You know that’s the truth trucker friends. The laws must be more stringent to make those corps. raise standards and make our roads safer! Until the big guys are hit hard, there will continue to be fatalities…children and families are at risk here! Consequences are the only way things will change in this state! LD144 was only the beginning.

    Jail time and lots of it is required to send a message to the rest of the irresponsible truckers that there is a cost associated with the taking of an innocent life and destroying someones home. There is no excuse for this type of behavior. 10 years minimum.

    If it was a car that hit two telephone poles, it never would have reached the house, let alone crashed through it and destroyed it. If you’re driving down the road and weight 50 tons, it would be nice if the person operating the vehicle knew what he was doing. With all of the truck accidents in the news and the damage that they cause, this is obviously not the case.

    90 percent of all vehicles on the road are cars or light trucks. That’s the standard. If the vehicle you drive doesn’t have the same handling characteristics then you have no business being out on the road because the equipment you are driving is as good as defective.

    You can wish in one hand and crap in the other and see which one gets filled first. What we need are changes in the laws so that a supervisor is in the cab at all times and that when a royal screwuup like this occurs justice is served and a message is sent to the trucking community that if you want to fall asleep and kill someone or destroy property, we’ll give you enough time in jail to catch up on all of that rest you so desperately needed. That kid was not doing anything he shouldn’t have been doing. He can sleep on the couch if he wants. What we need are drivers who are up to the job and know what they are doing.

    How about homicide, home invasion, assault with a deadly weapon to start with. Unsafe operation of a vehicle. They need to throw the book at him. The family should be justly compensated as well. I figure 10 million is a good starting point. It won’t bring the kid back but it will ease the pain. It will also send a message to the insurance companies telling them that if they don’t sit on these truckers and demand reform like two people in the cab at all times, they’re going to have to get used to writing big checks.

    I will tell you i see ALOT MORE irresponsible passenger cars on the road then i do truck drivers, so what if someone kills someone in their passenger car because they fell asleep? should it be the same punishment?     I wouldn’t waste my time looking up “the facts” as you call them because you wouldn’t believe them anyway. But I’ve been reading the same stories in the BDN for 60 years, been passed by speeding logging truck many times and have learned to get out of their way because they are driven by fools. If you have any facts to the contrary please show us.

    What an ignorant statement!  My father has been a truck driver for a long time now and he sure does not suffer from anything you mentioned and he is certainly not a pathetic loser.  My father-in-law as well who was also in the military before he drove truck.  My Dad’s driving helped put me through college and lucky you, those truckers bring all those wonderful amenities I’m sure you enjoy on a regular basis!  Please use a little common sense before you go around stereotyping and insulting people and their families who are just trying to make a living.

    Today’s truck accident so far is a truck that hit a bus in NY state. No innocent people were killed but 20 or so were injured. I’m not just talking about logging trucks. I”m talking about trucks in general. I believe that if you look you will find at least one serious truck accident every day. Probably more. Trucks may not be here to stay. They’re inefficient, they destroy the roads, create air and noise pollution, and as we see all too often they kill innocent people.

    It’s not practical to electrify trucks.

    Rail on the other hand can be run directly off of nuclear power if necessary. How? Nuclear power plant to catenary to the electric engines. Look at the North East Corridor, some of that power on those electric trains has got to be generated by the various nuke plants along the line. Can’t do that with trucks.

    By the way, even though I am a railfan, if a train derails and injures or kills someone, you’ll hear me yelling just as loudly as if it were a truck. I want heavy compensation for those affected and justice for those that caused the problem. The difference is that it is relatively rare for a train to derail and kill or injure people. But, when it happens, the railroads cannot look to me for sympathy.

    Fairness and justice.

    I suspect that what you are going to see is that trucks will become smaller and more and more freight is shifted over to the professionals of surface transportation. These are the people who move 10,000 tons at a time and do it on private property. They do it ec0nomically and for the most part they do it safely.

    When I drive to work, the chances of me being injured by a train are virtually zero. The changes of being injured or killed by a truck is much much higher.

    Professionalism is not so much about getting paid, it’s about the elimination of errors, it’s about doing things right.

    The biggest thing that the train crew needs to worry about is some truck not stopping at a grade crossing. You’ll recall that a week ago or so we had that happen in N. Berwick Maine.

    Trucks are a menace and when you come right down to it, they’re not necessary. We have trains going up to the top of Mt. Washington. Where can we not run tracks?

    So, as I say, trucks are likely to get smaller as the price of fuel goes up and the professionals take over transporting the majority of freight.

They seem to either get stuck on them or somehow manage to cross them at the same time as a train. They don’t understand that there are problems with trying to occupy the grade crossing at the same time as a train.

    Another one of their many weaknesses is that they don’t seem to understand that bridges are not going to raise themselves so that they can pass under them. Truckers seem to have to find out the hard way that most bridges are fairly well built and don’t yield very much when a truck hits them.

    I can’t help but wonder if they read the sign indicating bridge height, then look and if there are no cops around, proceed under the bridge even though their going to give their truck a haircut.

    Reminds me of a story from the UK where a doubledecker bus gave the passengers on top a haircut when he went under a bridge that was too low.

    Keep in mind that trains were delivering goods before trucks. As fuel prices go up, the trend is going to change back towards trains. I think trucks will get smaller and their routes shorter as the professionals get more and more freight and trucks carry it the last mile or two. That makes much more sense. I feel that truckers are punished enough when they kill people. Look at the Lake Butler accident. 7 kids killed, a school bus sent airborn, the grandfather of the kids has a heart attack and dies after hearing the news. What did the trucker get for punishment? 7 years. 1 for each kid. So a childs life is only worth 1 year? I say 10 years per person killed. In his case it would have been 80 years. That’s more like it. Maybe someone in the family, what’s left of it will see that justice is served after they guy gets out of jail.

    The cost of the additional person in the cab would have to be passed onto the person who is shipping the product.

    If I was doing something at my desk that had serious consequences if I made a mistake then I would want to have a second set of eyes on the problem or a supervisor within a few feet. That’s what they do in air traffic control. Makes a lot of sense and I support it.

    The cost of the additional person in the cab would have to be passed onto the person who is shipping the product.

    If I was doing something at my desk that had serious consequences if I made a mistake then I would want to have a second set of eyes on the problem or a supervisor within a few feet. That’s what they do in air traffic control. Makes a lot of sense and I support it.

    “Truckers get a free ride because they don’t pay their fair share of the cost of maintaining the roads. “- Did truckers stop paying taxes at some point that I’m not aware of?  These are public roads not just for use by truckers like the rails would be.  Last I knew, that’s where part of our tax money goes and they pay just like everyone else, sometimes in more than one state because of where the main terminal is located.

    Drivers are responsible for themselves.  When my father interviews for a job, he tells the companies that if he feels tired he is going to pull over and sleep whether it makes him late or not.  They have the choice to hire him at that point.  Having someone else in the cab will not prevent accidents, because who’s to say the passenger won’t be sleeping while they ride.  Can’t have a whole lot of conversation to keep you awake all the time in trucks because there is so much noise.

    How about we also regulate doctors and emergency workers that have worked 24 hours straight or more and are driving tired on the road? They can cause accidents.  They can go off the road in residential areas. Should they have someone else with them, or should they have the common sense to rest first? 

    As I stated in another comment, there are many more regulations for truckers than people know and understand.  They are getting stricter all the time specifcally for the safety of the trucker so that companies cannot force them to run illegally and also for the safety of the public because they should not be driving tired.  There is a lot more attention paid to how to regulate drivers and many more ways to take a trucker’s license than there are for everyone else doing stupid crap on the road.

    And I would expect that if you had a job that affects people’s lives, like I do because I’m a social worker, you would have the knowledge to make the appropriate or best choices possible.  If you were unsure, I would expect you to be a responsible enough adult to run it by your supervisor for a second opinion.  Once again, being an adult, who is responsible for your own actions.  Why everyone feels the need to have someone beside them holding their hands all the time is just beyond me!

    youve got way to much time on your hands, im talking state your talking entire US, yea of course there is going to be an accident daily in the US, but not the state you bone head, how many car accidents are daily? alot more then trucks, and trucks put alot more miles on then passenger cars… trains are more efficient yes, but how are you going to get products to all the mom and pop stores, retail stores, etc? put rails to every store in the entire US? i imagine, trucks are WAY more capable then trains, they go ALOT more places then trains do and you know that, if rails were so great they wouldnt be in survival mode like they are now, if the road is wide enough a truck can go where a car can go, as where trains cant

    i come from a family of truck drivers, my father was actually the state champion 3 times in the truck driving compition, and my uncles are all accident free, my cousin is accident free, and my friends are accident free, i can bet that TreeHugger9 and CVBG both have been in motor vehicle  accidents they caused, they can make fake facts and statements but the ones that know trucks know the truth behind the wheels the rest can just speculate

    Me too.  Many family members on both sides are truckers.  I think this is just an open forum for people to spout stuff off they know nothing about and mostly stuff they wouldn’t say with their names attached or in person!  There are irresponsible drivers, but like I said it’s not the majority.  Most are just trying to make a living and log and chip trucks have it the worst sometimes trying to run as legal as they can without the companies coming down on them.

    You can blame the wonderful GPS technology for truckers getting stuck a lot of times now.  GPS systems are not set up to tell drivers about roads they are not able to travel on or have lower bridges.  Everyone loves technology but a good old map is the best way to avoid roads trucks aren’t supposed to be on.

    Actually, judging by the news it appears that everyone except truckers are more likely to get hit by a truck. For some strange reason truckers have an affinity for being on the grade crossing  just as a train is coming. Normally you really have to try to get hit  by a train but truckers seem to do it as a matter of routine. Case in point the Berwick Me incident.

    Whenever you are hit from behind, the fault lies with the person who hit you from behind. Unless your equipment is defective, if he can stop, so can you.

    The best way for a regular motorist to understand would be for them to have their brakes set so that they take 5 times or longer to stop the vehicle. That would emulate a truck. Of course, it would also be illegal but it would illustrate one of the many reasons that the large trucks shouldn’t be on the road. They are incompatible with the majority of vehicles and thus do not belong on the road. We don’t allow bicycles on limited access highways either, bicycles and pedestrians are totally incompatible as well.

    As a railfan, I don’t mind getting stopped at a grade crossing  but I can see how it can be annoying. It’s not as annoying as having your house destroyed and your son killed by a truck.

    Trucks will always be with us, I see them as getting smaller though.

    I figure that a 10:1 ratio is about the maximum between the heaviest and lightest vehicles on the road. thus a 20 ton truck would be about as big as you would normally see.

    For heavier loads, special permits, police escorts, etc could be used. There are times  when very heavy loads have to go over the roads.

    Why ship logs by truck? Logs are heavy, why play around like little kids and ship by the small truck load when you can send them out 10,000 or so tons at a time.

    And, do it with 1 horsepower per ton. Try that with a truck.

    You choose where you live, if you don’t want to live near the tracks, then don’t. I would not want to be right near the tracks in case of derailment.

    I don’t see any change with UPS/Fedex and small trucks like that.

    The loggers can put down as much iron as they want to or they feel they need.

    On their own property they can do what they want, use trucks for all I care, but for long distance hauling or for hauling a lot of tonnage, rail wins.

    Of course, I admit that it would help if we didn’t have the ilk of Pan Am Railways in New England. If anyone tells me that they ship via truck to avoid Pan Am Railways, believe me, I understand and quite frankly don’t blame them.

    In the name fuel economy and safety, but mainly because of fuel issues, I see rail coming back and taking the majority of long haul freight.

    In New England we have very poor railroads, everywhere else it’s a different story. Imagine 10,000 tons pulled by 10,000 to 12000 horsepower blasting by you at 70 mph. Happens all the time out west. 

    Summing up  the inconvenience caused by trains at a grade crossing, at least it doesn’t kill you.

    I look at it on a national basis because it’s a national, probably world wide problem. Small trucks would get stuff to mom and pops. Rail isn’t in survival mode, well maybe in New England but in the rest of the country it’s doing great. Warren Buffed didn’t bet the farm on rail because it was doing poorly.

    Smaller trucks will always be necessary. I see long haul trucking hopefully coming to an end due to fuel costs. Larger businesses like Walmart may find that at some point it makes sense to use rail at least to all of their distribution sites, then maybe to some of the stores.

    We have rail service to the top of Mt. Washington, so rail can go anywhere it has to.

    Like most solutions, it’s going to boil down to a compromise. Trucks, probably smaller, will continue to serve the last few miles while more efficient rail will do the long hauling.

    I do feel confident that they will take care of the problem.  At least no one killed,  there was no accident.

    The only case I can think of where a controller was at fault and a lot of people died was when an Embraer private jet and a 737 collided over the Brazilian rainforest because the controller had them a the same flight level going in opposed directions along the same route. The private jet’s winglet tore off the wing of the 737 causing the 737 to crash. Very sad tragedy. The incident could have been avoided if the TCAS transponder in the private jet hadn’t been accidentally switched off. TCAS would have alerted both pilots in time and told each one to take the opposite evasive action.

    The controller was thrown in jail.

    They pay taxes just not enough. 50 times the weight,  50 times the damage, 50 times the tax. Doesn’t work out that way. The roads have to be built to handle 100 tons because of the trucks, therefore they should foot most of the bill.

    It’s nice to hear that your father has his head on straight and knows what he is doing. Unfortunately that wasn’t the case with the guy in Jackman a few days ago.

    I believe that two people in the cab will help because they each have a different view of things and there is a good chance that a passenger may notice something and point it out to the driver. Take the case down in N. Berwick, it’s likely that the driver was distracted and didn’t start braking until it was too late, it’s very possible that a passenger would have snapped him out of it and got him to stop in time. After all, the passenger has a vested interest in saving his own life.

    The passenger has to be an experienced truck driver in order to know if the driver is waiting too long to brake or to notice if something else is wrong.

    If doctors or emergency workers start making the news because they are getting in accidents and killing people then yes, there will need to be some reform. So far I haven’t see that it has reached the problem level like trucks have.

    Truck drivers need to be held to a higher standard than regular drivers because the potential to kill and cause serious damage is much higher. The trucks are also defective when compared with 90 percent of the vehicles out there. They can’t stop as well nor take evasive action as well as a car. They also are much more susceptible to being overturned by wind. They’re a menace as I have said before.

    Truckers have proven time and time again that they need someone beside them holding their hands. Case in point, the recent Jackman ME incident.

    If an industry won’t regulate itself, then the government needs to step in.

    The railroads learned this the hard way. They used their monopoly power to gouge shippers and paid for it with heavy regulation that put them at a big disadvantage when trucks came on the scene and undercut them.

    Get your act together or the government will be forced to take action.

    The railroads had to learn the hard way too as far as safety goes. They were horrible in the beginning.
