PORTLAND, Maine — Maine made history Tuesday when it became the first state in the nation to approve same-sex marriage by voter referendum.

At 2 a.m. Wednesday, with 456 — or 62 percent— of 578 precincts reporting, there were 286,484 votes, or 53.3 percent, in favor of Question 1 and 250,809 votes, or 46.7 percent, opposed.

Matt McTighe, campaign manager for Mainers United for Marriage, which supports Question 1, declared victory just before midnight.

“Three years ago, Maine made history as the first state to pass marriage through a state legislature and have it signed into law by the governor. Maine made history again this year when we became the first state to bring a citizen’s initiative to voters in support of the freedom to marry. And we have made history tonight,” he told about 1,000 cheering supporters at the Holiday Inn by the Bay in Portland. “For the first time, we have won marriage at the ballot box.”

Carroll Conley, co-chairman of Protect Marriage Maine, which opposed Question 1, conceded in a statement emailed to the media about 1:45 a.m. Wednesday.

“When we started this campaign, we stated marriage was in trouble in our country,” he said. “The problems that have weakened this critical institution started long before this attempt to redefine it. We made the case for traditional marriage, but we are terribly disappointed we were unable to convince enough voters to hold onto the value of traditional marriage for society.

“We genuinely fear for the consequences we raised during the campaign. The fact remains, marriage still needs to be strengthened and promoted for future generations,” he continued. “We call upon the faith community to focus its resources on marriage — the basic building block of civilization.”

Conley said earlier that the vote did not appear to be going in his side’s favor and the campaign was “concerned.” He also said it lost Biddeford and Lewiston, two cities that voted to repeal gay marriage three years ago.

McTighe said same-sex couples should be able to obtain marriage licenses before the end of the year. The law passed Tuesday goes into effect 30 days after the governor and Maine secretary of state certify the election results.

Jen Hillstrom, 49, and Kimm Collins, 52, both of Falmouth, have been a couple for more than a decade. In 2003, they went to Vermont for a civil union ceremony. Seven years later, they were married there.

“Maine is our home and so we are ecstatic that we can finally get married at home,” Collins said after victory was announced in Portland. “Marriage matters to all Maine families and the good people of Maine recognized that and we are grateful.”

“It’s a thrill to finally know that people’s hearts and minds can change,” Hillstrom said. “We are honored to live in this state. Maine made history today.”

Collins said they plan to marry in Maine in 2014 because “one needs time to plan these things.”

McTighe said factors contributing to Tuesday’s victory included having the question on the ballot during a presidential election, when turnout is highest, and the three years proponents had to plan and execute a winning strategy.

“Tonight, here in Maine, we proved that voters can change their hearts and minds if we tell our stories and give our fellow citizens a personal connection to the countless families whose lives are impacted by this debate,” McTighe said. “To all the states out there that have seen marriage stripped away or blocked at the ballot box, take hope from the change that’s taken place over the last three years in Maine.”

Chad Griffin, president of the Human Rights Campaign, based in Washington, D.C., called Maine’s decision on Question 1 “a landmark election for marriage equality, and we will forever look back at this year as a critical turning point in the movement for full citizenship for [lesbian, gay, bisexual and transgender] people.”

“We are thrilled for all Maine families and for the dedicated campaign that led this effort through to the end,” he said in statement issued moments after McTighe announced victory. “As we celebrate victory tonight, we know we have added momentum to ensure that this victory is soon felt in every corner of this country.”

Re-elected 1st District U.S. Rep. Chellie Pingree left her own victory party to greet Question 1 supporters in Portland. Pingree said one of her proudest moments as a representative from Maine was when she voted to repeal “don’t ask, don’t tell.” That policy prevented members of the U.S. Armed Forces from being discharged for being openly gay or lesbian.

Former Gov. John Baldacci also stopped in at supporters’ election night party in Portland. In 2009 Baldacci signed into law a bill passed by the Legislature to allow same-sex marriage in Maine. It was repealed that same year in a people’s veto referendum by a margin of 53 percent to 47 percent.

Outside the crowded ballroom, Baldacci said if the referendum passed, it would not be his legacy but part of the state’s legacy.

“I want to say how proud I am of the people of Maine for being open to listening to the conversation over the past year,” he said. “There is something in the air and the water of the state of Maine that makes people fight for what’s right.”

Conley said he was proud of how his side had conducted the campaign.

“We believe we’ve conducted this campaign in an honorable way, in a respectful way,” he said. “Now we just have to wait.”

The Rev. Marvin Ellison, a professor at Bangor Theological Seminary and a member of the board of directors of the Religious Coalition Against Discrimination, disagreed.

“That may have been the intention, but I don’t think that was the actual result,” Ellison said. “I think the campaign stirred up people’s fears unnecessarily that somehow religious freedom would be jeopardized if same-sex couples could marry. I think there are real differences among people of faith [on this issue], but I also know people of faith [who] support the freedom to allow same-sex couples to marry do that in good faith.”

The total amount of money raised and spent by the Question 1 campaigns this year won’t be known until Dec. 18, when the final financial reports are due to the Maine Commission on Governmental Ethics and Elections Practices in Augusta.

In 2009, the campaign that wanted the law to remain in place spent about $4 million compared to the $2.5 million spent by those who wanted to repeal it. Earlier this year, supporters of same-sex marriage predicted they would spend between $4 million and $5 million on the campaign. Opponents said they would raise less than half of that.

During the most recent reporting period, Oct. 1-23, Mainers United for Marriage raised about $964,000. As of Oct. 23, supporters of gay marriage had raised a total of $4.3 million. The largest contributor for the period was the Human Rights Campaign Fund, based in Washington, D.C., which gave the campaign more than $300,000.

Protect Marriage Maine raised nearly $950,000 during the same period, bringing its total to $1.4 million. It received $800,000 in first three weeks of October from the National Organization for Marriage, based in Washington, D.C., and another $100,000 from the Knights of Columbus.

After the 2009 repeal, proponents of gay marriage began planning for a statewide vote in 2012. They gathered signatures to put the referendum on the ballot in August 2011. They were required to gather at least 57,277 valid signatures, or 10 percent of the total number of people who cast ballots for governor in the last gubernatorial election.

Advocates turned in petitions from 453 towns and cities on Jan. 26, 2012. Of the 96,137 signatures submitted, 10,921 were determined to be invalid, the Secretary of State’s Office said in February when it announced the issue would be on the Nov.6 ballot.

In New England, same-sex marriage is allowed in Massachusetts, New Hampshire, Connecticut and Vermont, and civil unions for same-sex couples are allowed in Rhode Island. Other states that permit same-sex marriage are New York and Iowa, along with Washington, D.C.

At least two of three other states considering same-sex marriage questions Tuesday voted in favor of the initiatives. In Washington and Maryland, voters approved bills to legalize same-sex marriage by rejecting bids to veto laws passed by those states’ legislatures. A measure in Minnesota that would define marriage as between one man and one woman was too close to call as of 1 a.m. Wednesday.

“Those who oppose the freedom to marry for committed couples are clearly on the wrong side of history,” said Rick Jacobs, founder and chairman of a pro-same-sex marriage organization called the Courage Campaign, in a press release. “More and more voters are coming to know that gay people are our neighbors, our co-workers, our fellow parishioners, our family and our friends.”

Before Tuesday’s vote in Maine, in the states where same-sex marriage is allowed, the laws had all come through either court orders or legislative votes, not through a statewide popular vote.

In February, New Jersey Gov. Chris Christie vetoed a bill to allow same-sex marriage in that state. A constitutional ban on gay marriage passed in North Carolina on May 8.

      12. If I met you in a casual situation and you told me you were married, I would not assume you were gay. In fact, I might assume the opposite. In the long run, if you corrected me and told me I was wrong, I would not care. In my belief system, God made all of us in His image or likeness. Does that mean that God is gay. No, I don’t believe so as most of us don’t think of God as a sexual being. What it does mean, is that he gave us each an immortal soul and the ability to make our own choices. A) The Vermont innkeepers weren’t sued because they wouldn’t perform a wedding, they were sued because they violated a non-discrimination law that says if you offer a service to the public you cannot discriminate. The service they were sued for not providing was a RECEPTION, not a wedding. B) The INNKEEPERS chose to no longer hold ANY events at their inn because they no longer had an events planner who left their employee long before the suit was filed and they decided they couldn’t afford to hire another one. You’re a perfect example of the lemmings that follow the right-wing drivel and believe anything you hear that remotely supports your bias whether there’s any truth to it or not.

          5. That wasn’t about gay marriage, that was about Vermont’s 1992 anti-discrimination law. Besides, the innkeepers decided to stop performing weddings before they were even sued.

          6. By the way, Maine has the exact same law about discrimination based on sexual orientation on the books since 2004. If you offer a product or service (public accommodation in legal parlance) you cannot refuse to offer that product or service to a person(s) based on sexual orientation in Maine. That was the law yesterday, last week and last year.

            All of the above religion, gender and national origin are protected classes just like sexual orientation.

            However, I support the right of INDIVIDUALS to make these decisions.  I believe that the original supreme court decisions to extend the concept of equal protection under the law, (the basis for preventing any form of discrimination by the GOVERNMENT), to individuals is wrong constitutionally.  This is just another part of progressivism giving government power over individuals.

            Individuals should be convinced to not discriminate by public pressure and education, not by imposition of law.  Thinking that a law will change things in this area is wishful thinking.  anyone who wishes to discriminate now simply uses another, legal, excuse to do so and people are left not knowing the truth.

            So when we cannot end discrimination through “public pressure and education” that is typically when the state and federal government steps in.

            So what makes you think that State or Federal government or all the laws in the world will ever end it?             The Civil War ended in 1865. The military was forced to desegregate in 1947. That’s 82 years. A black unit was one of the most decorated units in WWI. The Tuskegee Airmen fought and died in a segregated unit in the 15th Air Force and escorted white bomber groups but couldn’t eat or socialize with those bomber crews.

            So how long does one wait Trickle?

            Oh and the first interracial kiss on network TV: Nancy Sinatra and Sammy Davis, Jr on Sinatra’s variety special December 11th, 1967. That’s 102 years so how long does one wait for education and public pressure to work?

            If you own a business, it is your property and it is not any sort of local monopoly I firmly believe the government has no place telling you what limiters you wish to place on your business.  If you wish to exclude people with Blue eyes because you have a blue eye phobia then do it.  I’ll open a business across the street and provide that service at your expense.

          9. So if you own a gun shop you should be able to sell to anyone?

            What about alcohol and tobacco products? Should the government limit who you can sell to and at what age?

            If you own an apartment building should you be allowed to board up exits so people can’t skip out without paying you rent?

            Those pesky smoke detectors that the government forces you to place in rental apartments are such a bother too since you have to replace batteries in them and who pays the cost of that?

            If you want to discriminate because someone has blue eyes have at it. May freckles bother you too. If they do don’t sell them your product or service and there is not one thing the state can do.

            But if you wish to discriminate against someone because they are black, Jewish, lesbian, Arabic, have a cleft pallet, are a woman, or have are bipolar you are going to have a problem. You don’t have to like it, but that’s the law.

            If you don’t like it, write your Representative or Senator and ask them to sponsor a bill to repeal it. Or you could state a people’s veto if you think you can garner enough registered voters on the petition.

            But until you do it’s the law and it doesn’t matter if you like it or not.

            Who is limiting your Freedom of Speech? Not me and I don’t see anyone flagging your posts either. And SSM does not limit Freedom of Religion either. It really does the opposite. It allows those religious groups that want to perform a marriage ceremony for a same sex couple to perform them. It also says if a religious group doesn’t want to perform a marriage ceremony they don’t have to and there are no consequences for refusing to do so.

            I could care less who marries whom.  Marry your dog if you wish.

            I want this government and State governments to stop forbiding people from speaking out about the things they do not like in whatever manner they wish to speak out.  I want this government and the State to stop claiming more and more control over what people do with thier personal property (their business).

            No one has taken anything from you. You are just as whole today as you were November 5th.

            You are also free to say whatever you want about any group of people you want. Sure, there is a penalty when you participate in discrimination but that doesn’t prevent you from speaking your mind or limiting who you serve in your business.

            The state and Feds say you can say what you want and not serve who you want but be prepared to pay the penalty. Same thing with a speed limit. The state sets the speed limit but they don’t put a governor on your car. You can go 100 mph if you wish. You just have to be prepared to write the check at the end of the day.

            So bottom line, if you want or wish to discriminate based on any of the protected classes have at it. Stand up for your principles and speak your mind, serve who you want to serve at your business. That is your right. The state and Feds might come knocking on your door but if you really believe in your position you will be prepared to pay the penalty. Just like those Patriots stood on their principles in 1776.

          15. You want to stand up and speak out? Do it.

            You want to change the law(s) that are on the books concerning discrimination stand up and petition your elected representative. Take a stand. Do something about it.

            If your elected representative won’t put a bill in the hopper then start a petition drive to force a people’s vote on it.

            Basically do what the Yes on 1 group did. They stood up. They gathered the signatures to get it on the ballot. They convinced enough people to vote for it and SSM will soon be legal in Maine.

            Don’t like some? Do what is necessary to change it. I took a stand. I spoke with family members. I spoke with friends. I spoke with co-workers. And we ALL voted. And one side won and one side lost.

            So rather then whining about something do something about it. It takes a great deal more courage to try and change something in the face of people calling you every name under the sun then it does to whine about what you “lost” when nothing has been taken away from you.

            Maine’s discrimination laws protect both you and I from being discriminated against in housing, employment, and services from businesses open to the public.

            The 1st Amendment protects churches from having to perform marriages for anyone they don’t want to marry— this has been true for 200+ years. Catholic churches routinely refuse to marry excommunicated Catholics, as just one example.

            There are no rights that I have that you do not have. And now that civil marriage for same-sex couples has been passed in Maine, our government treats us both equally under the laws of civil marriage, too!

          21. I don’t misunderstand our constitution, I don’t agree with it.

          22. Well, to be honest we’re both in agreement there. I am not a fan of ‘hate crime’ laws for example, and I also believe someone owning a private business should be free to decide who to do business with.
            My point is that there aren’t any laws protecting gays and lesbians that do not also protect Catholics, Jews, Muslims, Baptists, Methodists, Mormons, etc.

I agree with your point and I was not claiming that there were laws different from one group than another.  Like you though it is the hate crime laws I am against.  I think these laws do two very bad things.  First it takes away one persons freedom in order to protect anothers freedoms (most of the time when there is no protection needed), but more importantly to me and I think it should be important to others is it actually hides a problem that we should all be able to see otherwise.  If there is a person out there who has a hate on for a certain group of people and runs a business wouldn’t it be really nice to know what his or her real views are?

        Question 1 protects churches as well. Churches will not be required to marry same-sex couples if they do not wish to do so.

          2. There is no “inheritance” tax and life insurance proceeds pass tax-free to the beneficiary unless dividends or other income has been earned by the policy.  If there is income associated with the policy that portion of the proceeds is subject to income tax.

          3. Single people can’t buy life insurance?  I admit, I don’t know much about insurance, but I’ve never heard that single people can’t buy life insurance.

God is not invited to my heterosexual wedding….does that mean my marriage ceremony will not be valid and I won’t be married? Of course not, because religion has nothing to do with marriage. Congratulations Maine on your pending vistory in favor of full equality for all.,  Here in Maryland, it is very close, but we are still ahead 51/49 with 80% of precincts reporting.  Since our polls closed earlier than yours, technically we will be the FIRST (by 1 hour) to approve same-sex marriage by statewide referendum.  But it will be a VICTORY for the residents of both of our states! :)

    1. No, Maine will be the first state to proactively enact gay marriage by vote. Maryland had their legislature do it and then voters affirm it.

I did not realize that the Maine question was the result of a voter initiative as opposed to a referendum (like we had in MD).  Both are statewide votes on the issue.  Both passed.  We are the first 2 states in America to support same-sex marriage in a statewide vote by the people.  VICTORY for all of us! :)  Of course civil rights should NOT be subject to popular vote, but the tide has turned!  We will not go back!

    Yes’ it is secular law but it cannot interfere with my Constitutional rights…your rights ends where mine begins and vice-a-versa.  I have a right to bring up my children to believe in God and His Word.   But, when I bring my children out of my home and my children see woman kiss other woman like a mom and dad do… this interferes with their religious upbringing and will influence their thinking…schools in other states are teaching that these ungodly unions are OK.  Well my faith says other wise and it is unconstitutional for anyone to violate my right to educate my children in My faith.  Do what you want behind closed doors (free will) but don’t influence my children and grandchildren by teaching them through law and by your actions.  This is a true Republic!  As for God being for Love, yes this is true but He set the rules which can be found in the Book of Leviticus: 18:22  “No man is to have sexual relations with another man; God hates that.”

      It’s hard for us as individuals to change the big picture, but we can have influence over small parts of our world.  If you help God to lead your kids to salvation, you will have accomplished very much in the world.  If you can lead even just one or two people from outside your family to salvation, then your life’s accomplishment will be that much greater.  The value of one human soul is infinite.  So just doing your small part for God has value far above than what is available for us in this world.

      Remember that Jesus said we should not fear those who can ki-ll only the body; rather we should fear him who has the power to cast body and soul into hell.  What many of these liberals seem to forget, is that we are all going to die.  Death is the great equalizer for us all. Whatever seems unjust and Godless in this life will be re-balanced by God in the next life, eternal life.  So don’t lose heart.  The Bible tells us that those who persevere to the end will be saved.  Just put your life, and the lives of your kids, into God’s hands, and let him do all the heavy lifting.  Be prepared to die and to meet Jesus Christ at every moment of your life, teach your kids the same, and you will have nothing to worry about.

            He was raised a “good far right Christian conservative” and he was gay. Wasn’t anything the parents could have done about it. He is what he is and he is now out to his family.

            See we can teach and educate our children in any way and manner we want but they don’t always “turn out” how we want them to.

      1. Ah the “gay agenda” argument. A few things have to change before the Feds recognize SSM. Those things include repeal of DOMA and settling several cases moving through the federal court system. Until that happens the Feds can continue to refuse any program/benefit to a SSM couple.

Can you tell me with full clarity that, repeal of DOMA is NOT next.  Many posters have already stated that they wanted DOMA repealed.  It is the next logical step.  Many pro-SSM, didn’t just accept civil unions, b/c it didn’t give them the same benefits as being married, now being married doesn’t give the same legal benefits as a hetero couple b/c of DOMA.

          1. It is a natural extension as under current law when a SSM couple move from a state that recognizes SSM to a state that does not, that SSM couple lose all rights and privileges of a married couple.

            That’s not the case for you and me. If my wife and I move or when when travel our marriage is just as valid as any other marriage. So why should a SSM couple be different?

  46. Yes, I am being a sore loser today. I’m mighty upset, and sick to my stomach about it. But I will say one thing…   yes, it may have passed….but for almost 50 % of Maine’s population, not accepted. So don’t expect it. Because we will NEVER accept it, nor pretend to.

    1. The civil rights movement in this country mean nothing to you? Not all people agreed with it, but it is law and should be respected. Just because you do not believe in homosexuality doesn’t give you the right to suppressing an equal member of our society from marriage – which by the way is a state legal union not a religious law. Please do not spread hate towards the LGBT community. They have just as much right to marry the one they love just like everyone else. I hope you get by your bigotry and see that everyone has the right to vote, to use public restrooms, sit in the front of a bus and now marry their gay partner. I am grateful to not be in your position of close-mindedness…

    2. It’s not your acceptance we sought. It’s equal treatment under our government we were seeking, and thankfully the majority of Mainers agreed that allowing ALL Maine families access to civil marriage was the right thing to do.

      1. Even though you won the vote it still doesn’t give you equal rights because it still hasn’t been passed at the federal level. Big deal you can sit with your beloved loved one when he or she becomes ill that could have also been accomplished with a simple piece of paper called power of attorney and it would have saved the millions of dollars spent on this topic. All the money raised could have gone back into the communtiy to help with jobs and maybe build another homeless shelter instead of being worried about a damn peice of paper. S

          And I totally agree that all this money could have gone to homeless shelters and other help for those less fortunate. Blame the Catholic Church and National Organization for Marriage for that though— they are the ones who started the whole lying and deceitful campaign in 2009 to repeal these benefits from us!           2. Who made the signs, who sold the signs, what was the profit used for? Somewhere this money was spent in Maine. It doesnt just disappear. They had to hire people to do the work. They had to purchase the materials. Commercials pay the people who work for the stations who in turn support their families.

I had a customer come in last week who mind you is living in subsidized housing all excited about the check she got for helping the yes on 1 bill she was happy she had some spending money. I asked her what she would do for money after the campaign was over her response was same as i currently am doing collecting state benefits! She then proceeded to purchase a vehicle in cash in excess of 13,000.00 however she didn’t want the paperwork to be sent to the irs about the 10k or above cash purchase so she paid for it half from her partner’s checking account to avoid the reporting to the irs……… Gotta love good ole Maine.

Speaking from personal experience and as a person who held a Power of Attorney, Durable Medical Power of Attorney and Health Care Proxy for not one but two terminally ill relatives I can assure you that you are placing way to much hope on a piece of paper. In both case all three pieces of paper (duly executed, witnessed and notarized) were ignored by the local Bangor healthcare facility and their medical director. The stated desires of my relatives were ignored on a routine basis.

Maine is the least Churched State in the Nation. To all of you who responded to my comments in a very negative way…Let us leave this to God, let Him say on which side he’s on…His Word or yours.  I prayed a pray this morning through this forum asking God to reveal himself as true to His Word… by answering my prayer-check my comment below to see that prayer…until three days have passed, don’t comment on this, and this is my last statement!  I’m not God, I did not make up the rules- He did. I believe God always is first served…He said No!  And, let me add that I do not hate any of you.   The hate comes from your own assumptions.  To those who responded with words of encouragement to hold true even to death…I agree!  Let me also add that I am truly for all faiths…their true faiths.  I have studied many faiths and what I found was that most faiths are required to follow the first five books of the Bible…much abuse today comes from these religious wars because on-the-whole man does not know his or her faith.  If all of us studied our religious beliefs from a codified Word of our Religion and not that of secular man’s desires…we would live in peace.  Again, let three days pass before you respond…if the miracle does not happen you can laugh at me in this public way.  BUT WHEN GOD DOES WHAT I PRAYED FOR …TO PROTECT HIS WORD…then repent-GOD LOVES YOU ALL AND WANTS YOU TO BE SAVED.  

  49. I went to parochial school for 11 years, switching to a public high as a senior because my Dad was dying and I wanted to be closer to home.

    Between my education and upbringing, I came away with the outlook that God’s greatest admonition to mankind was “Love thy neighbor as thyself” or “Love one another as I have loved you.”

    Perhaps He created people whose lifestyles or heritages are the minority in any society, to see if we really could love one another, created by Him, in His image, as He love us. We are all His children. 

    I proudly voted yes on Question 1, because it is my belief that I have an obligation to make this a better world for my children, their children, and their childrens’ children. I can love many men and women regardless of their sexual preferences because I believe they are God’s children too.

    So I guess I could say I voted that way because of my religion not in spite of it.

      1. I didn’t say anything that was untrue. I would not lie. The church was in Sangerville, Maine. His ex wife’s name is Sarah. He cheated with a parishioner. Sarah lives in another state. We moved here knowing that Maine was a much more inclusive and forward thinking state, one where the rights of the individual is respected and now after living with my partner for 30 years we can make it legal. We can uphold the respect for marriage in a truly tangible way.

      Apparently the Intelligent Designer,  in its wisdom, included a recessive gene for homosexuality that has been maintained through the ages, so that heterosexual people have been producing homosexuals in some proportion to their numbers since they arrived on the earth.
      Deal with it.
