HERMON, Maine — Daniel Williams, 24, was asleep when someone knocked at the front door of his apartment around 9 a.m. last Thursday. Moments later, he was in a fight for his life, he said Monday.

Williams fired shots from a handgun last week that mortally wounded Robert Dellairo, 30, and injured Philip McIntyre, 19, both of Bangor, after Dellairo and McIntyre broke into his residence at Duran Apartments on Outer Hammond Street, according to Maine State Police.

“They attacked me in my home, and I had to protect myself,” Williams said in a telephone interview over the weekend.

Just before the shooting, Williams answered the door to find a woman he didn’t recognize.

The woman asked to come in because “she said she knew the people that lived there,” Williams said. Williams was suspicious of her claim because he knows all of the apartment’s recent residents and most of their friends, he said, and this woman wasn’t familiar to him.

After a short conversation, Williams told the woman he had to get dressed for work and began to close the door. Before the door latched shut, Williams said, Dellairo and McIntyre came out of hiding somewhere near the entrance and hit the door, forcing it open.

Williams said the force of the two men hitting the door knocked him to the ground. McIntyre came into the room and started throwing punches while Dellairo stood nearby with a knife in hand, he said. Williams said he fought back and that Dellairo entered the fray and took a few swipes with the knife, leaving Williams with a slight cut on his abdomen.

Williams said that during the scuffle with the two men, he managed to force the knife out of Dellairo’s hands.

Luis Ramos, 24, was also in the apartment at the time of the home invasion, state police said. Ramos ran from his bedroom during the fight carrying an electric guitar to use as a weapon, according to Williams, but one of the other men grabbed the guitar and struck Williams in the back of the head.

The two men proceeded to kick and punch Williams and Ramos, but Williams eventually managed to break away and run to his bedroom, where he grabbed his .22-caliber handgun and “did what I had to do,” he said.

Williams said he uses the gun for recreational practice shooting and that it was equipped with a laser sight.

Williams said he shot McIntyre in the leg and followed the injured man and his two accomplices out the door to be sure they were leaving. Once outside the house, Dellairo turned back toward Williams and lunged at him, Williams said. Williams said he “fired off a couple surprised rounds,” striking Delleiro in the hip. That wound would prove to be mortal.

The injured men and woman got into a blue Honda Accord waiting outside. As the vehicle drove away, Williams fired two rounds at the trunk of the car to serve as identifying marks for police, he said.

A female driver took the shooting victims to St. Joseph Hospital in Bangor, where police met the group, according to Lt. Christopher Coleman of the state police Major Crimes Unit. At the hospital, the vehicle appeared to have two bullet holes just below the rear license plate.

Dellairo was transferred to Eastern Maine Medical Center, where he died Thursday afternoon.

The car that took the men to the hospital is registered to Danielle Bellefleur of Bangor. Williams said the woman who knocked on the door and asked to be let in before the home invasion told him her name was Danielle.

Investigators are trying to determine the motive for the home invasion and exactly what drew Dellairo, McIntyre and the woman to Duran Apartments. State police have said Williams and Ramos did not know any of the three people who entered their apartment.

Police are investigating the role of a second woman who was with McIntyre and Dellairo at the time of the home invasion, according to state police spokesman Stephen McCausland.

Williams said Monday that he believes a former high school classmate who was in the car during the home invasion led the other three individuals to Duran Apartments.

”I honestly don’t know her that well; she’s just an acquaintance,” Williams said, adding that he ran into the woman and had a brief conversation a few weeks ago at an event in a club and that she was aware of the fact that he works as a contractor and owns an event-organizing business.

Williams said his apparent business success could have led the woman to believe there were things of value in his home.

Police have not released or confirmed the identities of the two women they’re interviewing in connection with the case. Neither woman has been charged.

“We are still investigating [the] incident and are not in a position yet to comment on the involvement of the other parties,” Coleman said via email on Monday.

The woman Williams said he believes led the other three individuals to his apartment has appeared in the Bangor Daily News after drug-related arrests and has been listed in court records multiple times facing charges related to operating a vehicle with a suspended license.

Dellairo had several convictions on his record, according to the Bangor Daily News archives. He was convicted of carrying a concealed weapon, driving to endanger and criminal mischief in separate 2011 incidents. He was convicted in October 2010 of assault, violating his conditions of release and burglary.

In May 2006, Dellairo and Bellefleur, his then-girlfriend, each were indicted on one count of burglary by the Penobscot County grand jury.

The indictments stemmed from the Brewer Police Department’s March 2006 search of a room at a Holyoke Street boarding house that Dellairo and Bellefleur were living in. The search, and a subsequent search of their car, reportedly led to the discovery of a stolen credit card and thousands of dollars’ worth of stolen property, including electronics.

McIntyre was treated at St. Joseph Hospital on Thursday. After his release from the hospital, he was charged with burglary and taken to the Penobscot County Jail. He was released on bail later that same day.

In August 2010, McIntyre, whose address was listed as Corinth, was fined $400 for assault, according to the archives. In 2011, he was fined $300 for theft by unauthorized taking and later that year was sentenced to 48 hours in jail for carrying a concealed weapon.

Williams said he acted out of self-preservation, but that doesn’t mean it’s easy to accept the end results of that morning’s home invasion.

“I’m very banged up about it,” he said. “I’ve shed a lot of tears behind closed doors for Bobby Dellairo and his family.”

  1. These guys totally deserved everything they got. Really, its not as thought its a bank. How much could you possibly hope to walk away with from breaking into someones home if you have this many people in a Honda Accord? Seriously, petty theft is as stupid as the people who commit it. 

    1.  There is a surprising increase in home invasions.  My guess is that they work, there usually are not cameras, and it is not a Federal crime, as is bank robbery.  In Canada, there has been a sharp increase there.  I personally think it is “dared to be done” as gun ownership in Canada is rare.  I certainly would think an invader would think twice about kicking in a door in Texas.  What is on the other side should be a huge concern.

        1.  Beg to differ.  The process for getting a handgun is close to impossible in Ontario.  Long guns, yes, but this requires registration and quite a fee.  I am in Toronto frequently and those folks are amazed at my collection of handguns (not that many) and how easy it is for me to obtain them.

I think he did a hell of a job using what he had.  I have a 12 ga. semi with 00 buck that would take care of all of them.  I’m not trying to criticize him, I was commenting on Kevin saying that the .22 did “just fine.”  My idea of “just fine” is taking them all out.  I understand there is a lot of adrenaline running and you can only do your best in a certain situation.  Trust me, I think this Mr. Williams should be cleared of any wrongdoing and shouldn’t have to go to court for assault. (If that is the case, we don’t know yet)

          3. This should get interesting, he did go out of his house and fire his gun, I think he should be cleared of any charges, but I will not be surprised in the liberal state we live in that he gets charged with something.

          4. Just think, McIntyre will finish his prison term in about 5 years and return to society after “turning his life around”.
            Within a few months, his next victim will wish Mr. Williams had been using a .40 and aiming for center of mass.

          5.  If someone invades a home and gets shot and killed, I agree, they were asking for it.  However, McIntyre is 19 years old.  You think that kid has done all the thinking he’s gonna do in life and he deserves to have his butt “blown to hell” ?  Sounds like a kid who got hung up with the wrong crowd- Dellairo was 30 with multiple offenses – No Hope.  But I say let the kid think about it and give him one last chance.  It’s just tough for me to condone blasting a teenager.

          6. What should he have done interview him before pulling the trigger? Run a backround check?  Shoot first ask questions later.

          8. Being 19 and involved in this type of crime is a statement itself. Most kids that age would be too scared to do something like this. A more seasoned criminal has no fear. The fact that he has the balls to take part speaks volumes to his mind set. I would feel much safer if they were all shot and killed, and I am not even a Republican!

    3. Of course, it is unfortunate that anyone dies or feels they have the right to rob someone.  I am sure the deceased’s family is suffering.

      But, that said, it is what it is. 

      From a purely technical viewpoint, I would point out that the weapon was equipped with a laser and he was able to get off these shots accurately.  That is surprisingly tough to do with a moving target and one’s adrenaline pumping.  Note, too, he was able to get two rounds into the car above the license plate “to mark the car.”  Again, tough shots presuming the car was moving.  The laser certainly made a difference.

      As far as the lethality of the .22, my guess was he was using regular .22 rounds as he used the gun for target practice and few people blow the extra money for .22 LR Mags/WMRs, etc. for target practice.  But, I don’t think this is the place to start a discussion on the pros/cons of certain rounds.

      My point is that I give Mr. Williams credit for saving his life and the life of Mr. Ramos.  I also empathize with Mr. Williams.  Taking anyone’s life is a terrible burden.  I hope he considers taking the same counseling offered to police officers who must take a life in the line of duty.  This is something he must live with forever.

      1. Your post brings a refreshingly rational perspective to this issue.  Thanks for posting it.  Often with these stories, we only hear from the gun fanatics (see most of the posts here) that call for killing anything that moves in the name of self-defense.

      2. A well-thought response, Chuck. And yes, the taking of a life, even in self-defense, is a gut-wrenching thing. Counseling is in order. Even the cops, when they have a righteous shoot, have to go through a psych session or two before going back to duty.

        1.  Exactly.  My point was that he hit the targets at all.  The laser allowed him to pick his shots  yet still hit the guys.  Often, inexperienced people start shooting and hit nothing.  The laser solved that problem.

        1. From a legal (if not moral) perspective, there may be a problem with the last two shots.  Maine law does not allow you to shoot at a fleeing assailant.

          1. Agree, but think like a lawyer, he followed them out, and he turned and attacked, if he stayed in the apartment, he was no longer in danger.

          2. Nothing moral about it if the story is true.  The guy obvious was not shooting to kill otherwise he would have shot into the back window.  Now there is no doubt the car was involved in the crime.  The most they could charge him with is assault but I doubt this will happen.

          3. That appears right . The story is clear that he uses the gun for target practice and it is equipped with a laser site. This would lead me to believe that he hit where he was aiming . It also woud lead me to conclude that his intent was not to kill his assailant but to wound him as he shot both thugs in the leg !

          4. This guy should get a pass if that’s the case. Tough pucky for the assailant, getting shot at, even in retreat, is part of the package these thugs buy into.

    2. they never will do that, the case has to go to court. and Williams, and Ramos will have to testify, and prove that he was justified in protecting himself and a third party from physical harm. they have to prove it without a reasonable doubt that it was self defense..  

      Shooting a moving vehicle is a police guideline.. as you shooting the persons, may cause an even bigger accident causing more loss of life, or placing others at risk. they would rather catch you on open road, do a pit maneuver, or get a tack strip to take you down. all depends on the situation.

      I think this man was perfectly within his constitutional right to use his firearm for personal defense.. should he have shot the car. don’t care. do I care that someone died.. yes.. but I definitly think the survivors need to re-think their criminal careers…

In a previous article Chris Coleman stated or maybe it was Troy Morton, “what defines self defense”,  in this case clearly Williams had a case to use deadly force, it basically comes down to how scared was Williams when this went down, did he feel his life was in danger, there really isn’t a whole lot to prove here, as far as the gun shots to rear of car, I don’t think that anything in article stated he fired shots when car was driving off, but if he had fired while the car was driving off, your responsible for every bullet that comes out of your weopon, cops as well, he may get reckless conduct or something of that nature but I don’t know all the details.

      2.  Wrong Scott.  There does not have to be charges or a trial.  Remember that the AG ALWAYS makes a finding that LEOs are defending themselves and does it without a trial.

        Self defense need not be proved by the defendant at all let alone BRD.  It need only be raised by any facts presented by either side.  Then the STATE must prove BRD that it was NOT self defense.  Your statement assumes guilt that must then be disproven, an all to common error by newspaper readers I’m afraid.  The legal  presumption is actully one of innocence.

I think the law states, if the attacker is leaving ur house, then you are no longer in danger if they are fleeing, the fact he followed them might get himself charged, as stated before, I would think it would be hard to just stay put, who know how you will react untill you are in his shoes.

    1. The story has been updated with more information, and Williams states that he fired those two rounds at the car so the police would have “identifying marks” to look for when searching for the car.

    1. When the investigation is completed the DA will probably make that decision. I think they have enough already to charge the woman who came to the door. We don’t know what they have against the other one so far. Maybe somebody gets a deal for testifying against the others.

  7. You put a scare into somebody and they keep on going like that energizer bunny. It will take a long pause in the action before they can think about their next move. If he had run after them and fired a few more shots I would still be very sympathetic. From the description of events I don’t see that he had time to think about doing things differently.

  8. People committing home invasions should just assume they’re going to be shot at. That way, it won’t be a surprise.

There are more and more of these thugs getting shot.  One not long ago in Eddington.  Another not too long ago down around Blue Hill.  In that case, the thug got killed too.  More and more people are arming themselves to fight back against this crap, so the crooks better beware.  Even if they are armed too, they risk getting shot.

  13. I feel sorry that this young man was forced into shooting at these loser’s. He will have to live with the fact that he had to take a life and for some people that is hard to take.   14. For those of you who think I shouldn’t use a handgun to protect my family and my property. Don’t worry, I won’t use my handgun to defend your property.  I’ll keep it right here in my yard. So as long as you stay on your property you will be safe. If you enter mine uninvited with weapons I will defend my property, with my weapons.  After I unleash the bullets, I’ll unleash my boy with the bear mace.

    1. Better be careful using a firearm to protect your “property” unless the assailant is about to commit arson or continues a criminal trespass inside the home after being told to leave. Otherwise, you risk the silver bracelets.  Inside your home you can use lethal force as reasonably necessary to prevent imminent serious bodily injury or death to yourself or others.  Once you’re outside the front door, remember our Legislature says you must retreat if you can do so in complete safety.  We have not become a castle doctrine state yet, unfortunately.

        Oklahoma, Texas, Arizona, Alaska, Idaho, Missouri and Maine. . . . By far, the popular concept in those states has been the “stand your ground” approach that permits a homeowner to fire upon invaders at first sight.

    people broke into the apartment tenants and their neighbor aren’t exactly ideal
    neighbors or people themselves I literally used to watch drug deals going on
    with the people that live in these apartments. Sorry to say but there has to be
    more to this story. I think these people were at this apartment complex for a
    reason plain and simple. Robert Duran is to blame for this too he had three
    tenants move out because of these neighbors we had to deal with. You would think
    that they would do backround checks but obv. not. The sheriffs were always
    there.

    1. Do you really think that the Duran actually preferred to have low-lifes in his apartments? In case you haven’t read a newspaper or watched TV news in about 4 years, housing of any kind isn’t exactly at a premium so if you own property you can’t afford to be real picky about who you rent or sell to.  More likely it’s as simple as the low-lifes you mention were the ones who showed up when he advertised the vacancies so that’s who got them.  Also, try turning people away because you don’t like the way they look and see how long it takes to get hit with a discrimination lawsuit.

      I can well understand the shooters feelings about having taken a life, MUCH easier to talk about than to actually do and live with.  But it sounds like he did the exactly right thing. He attempted to use the minimum amount of force necessary to alleviate the threat. The fact that one of the thugs died as a result of his wounds is the fault of those who put the shooter in the position of having to defend himself. If the perps had got a job instead of attempting to rob people, they’d all still be alive and Mr. Williams could have finished his nap.

    A lot of talk about .22 vs. . 40 call .45 etc. As an experienced shooter and gun owner that owns all of those calibers let me offer this cailiber. The 9mm is a very good home protection caliber. It packs a pretty good punch and has good accuracy. It is much cheaper to shoot then the 40 and 45 and doesn’t rock your hand every time you squeeze the trigger. I wouldn’t want to get into a gun fight with it long range but anything inside 100 ft it is fine. Practive, practice, practice takes time and money.

    BTW, this story is far from over. Many more facts to come. To many coincidences for me.

  19. Do not knock the power of a 22.There have been literally 1,000’s  of deaths caused by using a 22. Nice weapon, doesn’t buck and highly accurate and hard hitting at close range. I used the old army issued 45’s and they weren’t worth the extra weight to carry them. Don’t forget ..the M-16 is just a bullied 22.

  21. People need to understand what Mr Williams is saying……………it is NEVER easy to take a life, self defense or not. Previous posting are all fired up about how he did what he needed to do and people should take note that they will be shot if they enter “my” home. Just remember…………..you killed someone………even if you HAD to. These ignorant folks breaking into places don’t take into account the trauma that is inflicted on that individual that pulled the trigger. Sad for all involved. We can only hope that some of the folks thinking about home invasions may think twice. Mr Williams…………I wish you a speedy recovery and a great life!!

  22. One guy is dead the other gets out of jail on $60.oo cash bail and what about the women who helped set this robbery / homicide  up ? What about all the other stolen items from other robberies ?  They all need very long prison time and not able to collect disability. The women I have not read where they have been even charged yet ? The $60.00 cash bail just dumbfounds the system that is in play here. What judge allows this to take place ? 

    1. I agree with you that no one should be walking away from this other than the two who live at the residence but just so you know, some silly reporter posted the $60.00 bail story…they corrected it about an hour later after everyone was in an uproar…

They are all worthless low life’s and one of them got exactly what he asked for and deserved!  Now lets see if our judicial system deals with the other three properly or if it lets them off easy so they can go back out to maybe kill someone!  It just might be someone who is important enough to get them what they deserve, like a lawyer or judge etc. I don’t know all the facts in this case but I do know that I worked hard for what I have and lived within our laws while doing it so anyone who breaks into my home regardless of the reason is at risk of being shot and would have no one to blame but themselves!

  27. It’s not the caliber, it’s bullet placement. A shot tothe femoral artery is almost always fatal. And, those of you who believe that there’s more to this story are probably right. A home invasion into an apartment for valuables is suspect at best. The use of deadly force here is legal with the exception of shooting at a fleeing vehicle. The fatal shots at the deceased who lunged with a knifeat a man holding a gun sounds suspect. Do that math because it doesn’t add up.

WHO GIVES A CRAP,  you sound like your defending the dead beats, GOOD RIDONS.  As far as whats legal, give me a break, they just got attacked, I would have unloaded at that fleeing  vehicle.  Society is better off today than we were last week at this time. Good job Mr. Williams, 1 out 2 is not bad. I hope there is never a next time, but if there is put the laser sight a little higher.

    2.  Are you out of your mind.  Anyone within 20 ft. holding a knife when the opponent holds a gun is considered to be EQUALLY armed and just as lethal.  Police consider it justifiable to shoot and kill anyone  making a threatening gesture or statement within that range and have done so in other places.  The only drawback here is he only offed one instead of more.  Now the public will have to stand the expenses of trials for the other lowlifes.

Well, the one’s that entered the apartment have quite a history it seems of prior violence and ongoing issues with the law and thinking that another’s property is theirs for the taking…and what they got for on the spot justice was certainly, IMHO what they deserved……but, it also appears the woman (former classmate) who is “believed” to have “led the three individuals” to the apartment was known and had a chance meeting and a brief conversation recently with the resident about life and current lifestyle….this makes one to obviously conclude that the whole thing was not just chance and the residence was targeted……just goes to show, as with the recent Facebook article, if you do not know someone well or haven’t seen someone for years, one should be careful about sharing personal information and where one is in life…..makes more sense with the known connection than just thinking that this particular apartment in a complex was chosen at random….everyone from your past may not be the person you remember them to be……

  30. Well — one less to break into someone elses home  . They obviously had full intentions on harming anyone that got in there way . They just didnt count on them having a GUN !!!!!!!!!!!!!!  They got what they deserved and thats that they will get if they come to my house too !!! Except a bigger gun !!

  31. classic example of people who do not belong on the streets.  Our leagl system has to start throwing the key away.  Maybe Califonia style 3 strikes and you are out.  This is at a cost to the taxpayer but my life is more important than these peoples.

I wouldn’t  shed any tears for them low lifes, if situation was reversed and the home invasion a success they wouldn’t shed any tears over you.The police can’t save you, takes the police about 30 minutes to get to my home.If some1 kicks in your door be prepared to defend yourself, know your exit points if it’s night time then the light’s should stay off you know your home better then the intruder does use your head.

Good thing Mr. Williams had a LOADED firearm instead of one locked up somewhere with the ammunition locked up somewhere else or even kept at a shooting range as some bleeding hearts prefer.  Better yet, he had the will to prepare, by practicing at a target range before it was necessary to use it in self defense.  

  34. WAY too many home invasions lately. It’s time for lawmakers to increase the penalties. $60.00 and he’s back out on the streets again. Do we actually have any decent laws and penalties? The victim did the right thing, he was in fear of his life. I feel he also did the right thing by “marking” the car for the police as well. Then there’d be no question as to whether the police had the right vehicle or not. The victim probably saved someone else’s life in the future by getting rid of this scumbag. I’m sure if they had succeeded, they would have tried it again.

This gentleman should not feel guilty, after all he and his buddy might be the ones lying dead.  Apparently the people breaking in had no scruples about how they got their money and made a habit of stealing no matter what they had to do to get it.   Thank God he had a weapon and was able to use self-defense. 

  39. What a happy story!  I wish more of this would happen.  Maybe if everyone that burglarized a residence go shot it would stop.  Maybe pharmacists/pharmacies should be armed too.  

  40. Why a 22….?
    Like many, I have a couple of 22’s myself, but my go to self defense weapon is a 45.

    All in all it was his right to defend himself 

  41. .22 was the weapon of choice for Mob assassins: it has enough punch to penetrate bone (meaning it can just as easily pierce flesh, like a heart), but not enough to burst through the other side. Shot in the head, it bounces around the skull and turns the brain to swiss-cheese, ensuring the kill. A larger caliber weapon risks the chance that the bullet will go straight through, and while making a huge mess, isn’t always fatal. A .22 is a good gun for home defense if you still want to live in the home the next day without washing a few pints of blood and brains out of your carpets and wallpaper.

    1. Just call Service Master Clean! It could be a form of stimulating the economy. But I agree with what you’re saying on the .22 choice.

  46. I agree that any person in physical peril within their own home: Has the immediate right to defend themselves to any extent necessary. What I don’t agree with is paying taxes to Maine. Having those funds diverted to the MDEA to play dumb with. Luiz Ramos and Bobby Delleiro in fact knew each other.  They also know that they are both known drug abusers in the area. Every Junkie in Bangor is screaming it from the rooftops. So are we going to admit this was a pre-meditated crime yet to the public?

Well, let me first say I am a big advocate of our 2nd amendment rights, have held a concealed carry permit for 20 years, my H+K replaced my Amex as I never leave home without it, and I even have a couple NFA Class III weapons, that having been said, sadly this young man will be facing serious legal problems.  First, don’t say another word to the media, they are not your friend.  Giving him the benefit of the doubt things happened the way he said they did, the shot fired in the apartment will most likely be justified as it should be.  However, things outside will be another story, the fact he followed the fleeing assailants, and got close enough to be within attack range a second time does not add up, sadly this is the shot that may cause him the most problems as it resulted in the genetic removal of Dellairo, which was a good thing, but not outside in the dooryard, and the whole “surprise shots” – very very bad, you have the right to remain silent, I suggest you start to use it.    I would bet a weeks paycheck that he is indicted for firing at the vehicle, most likely reckless conduct with a firearm, which is a felony.  Getting the license plate would have “marked” the car just the same.  I have no issue with using deadly force when it is necessary, however situations like what happened outside of the apartment are what lead to stricter gun laws and law abiding gun owners getting a bad name.  I hope I am wrong here, but I would not want to be in his shoes moving ahead.
