Bangor councilor’s donation to city isn’t a conflict, experts say

Bangor’s city charter includes a section (33-8) pertaining to restrictions on gifts and favors to councilors:

A. No City employee, City Councilor, board member or commission member shall accept any gift, favor or thing of value, whether in the form of service, loan, thing or promise, from any person or business which to his or her knowledge is interested directly or indirectly in any manner whatsoever in business dealings with the City, nor shall any City employee, City Councilor, board member or commission member:

(1) Accept any gift, favor or thing of value that tends to influence that individual in the discharge of his or her official duties; or

(2) Grant in the discharge of his or her official duties any improper favor, service or thing of value.

B. Nothing herein shall prohibit the acceptance of gifts or favors by City employees, City Councilors, board members or commission members from members of their immediate families. In determining whether a violation of this section has occurred, the Board of Ethics, in cases referred to it pursuant to § 33-21 of this code, shall consider the monetary or pecuniary value of the gift, favor or thing received; any special economic value the gift, favor or thing received may have to the recipient; the circumstances under which the gift, favor or thing concerned was received; and whether a public disclosure of the receipt was made by the recipient at the time.

BANGOR, Maine — Both City Solicitor Norm Heitmann and the Maine Municipal Association see nothing wrong with the donation of a website content management system to the city by a councilor’s business.

“There’s nothing in the charter that prohibits a councilor or his business from making a donation, or the council from accepting that donation,” Heitmann said Tuesday, the day after sparks flew at a finance committee meeting when Councilor Charlie Longo suggested that the donation created a conflict of interest for fellow Councilor and Mayor Cary Weston. “Sutherland-Weston’s offer, and the city’s acceptance, are perfectly proper.”

Sutherland-Weston Marketing/Communications, a Bangor business co-owned by Weston, offered to donate its own $7,000 content management software for the city’s newly redesigned website about six months ago. The city’s finance committee was poised to vote to accept the donation when Longo raised the conflict-of-interest issue and accused Weston of influence peddling by “buying access.” The matter was tabled so that Heitmann could be consulted and the full council could take up the issue next week.

“In this instance, we have some very involved ordinances, and I can understand how someone might be confused,” Heitmann said. “Obviously it doesn’t apply. I let them know this morning that everything is fine.”

Heitman, who has been working for Bangor since 1995 and has been the city solicitor since 1999, said he couldn’t recall any councilor giving the city anything during his tenure, but that there have been many instances of the city having business dealings with companies owned by or employing sitting councilors.

“In terms of donations, I don’t recall that, but in terms of having contracts with business owned by or employing councilors, that has happened numerous times,” said Heitmann. “We’ve had councilors who worked for Bangor Hydro, EMMC, Sawyer Environmental.”

Geoff Herman, director of state and federal relations for the Maine Municipal Association, said he sees no conflicts or problems with Sutherland-Weston’s offer or the council’s acceptance of it when it comes to state law, established MMA rules or Bangor’s city charter as he understands it.

“I’m not familiar with Bangor’s charter, but there’s a generic law on the statutes for conflict of interest if you don’t have anything in your own charter,” Herman said.

The Maine Municipal Association is a nonprofit, nonpartisan voluntary membership organization that offers professional services to municipalities and other local governmental entities in Maine. Bangor is not an MMA member.

“If you have a 10 percent or greater interest in the business or entity coming before a board you sit on, that’s a defined conflict and you must recuse yourself from the decision-making process,” said Herman. “Based on the gifts and favors section [of the Bangor City Charter that was read to him Tuesday], and our own guidelines, I see no problem.”

Herman said another guiding principle his organization stresses and urges is to always avoid the appearance of impropriety or conflict of interest.

“It appears to me that the language … seems geared more to individuals receiving gifts or services and doesn’t seem to prohibit the board from accepting free goods or services,” Herman said, referring to the city charter. “In Bangor’s case, the governing body and legislative body are essentially the same, and there’s potential for confusion over the issue, given the charter, but there appears to me that there’s no conflict.”

    Can I use the Cities Attorney and have the MMa for my personal use???  

    What happens after 6 months of free use???  It would be inconvenient to use someone else’s product and thats where the cost escalates…. Take the one for 3 grand… no hidden fees or surprises….

    Have they donated or given this progam to anyone else???  If they have, have they paid the $350.00 sales tax for the value of the product.. I think an Audit is needed at S+W  to see is the are giving away $7000.00 in products to all customers… in order to hide real sales then charging on service…  Funny how things work out in life.. One is a mistake, more than that could be criminal intent to conceal sales revenue from the Maine revenue sales tax department…  If I were a Loophole Artist how would I explain it all away?????

    The MMA and the Bangor City legal counsel may be right… then again, it should be noted that the MMA and the legal counsel for most cities/towns will almost always “find” the result wished for by the city administration majority.

    Being an employee of EMMC, Bangor Hydro, etc is a far cry different than being a co-owner of the business.  The more I thought about this the more I became irritated with it.  Since the town is using their software, if there is a problem with it they’ll have to turn to that business for to fix it.  I also looked to see the different companies that use their software.  I have experience using one of the sites and they had constant network and site problems.  It’s not even that good of a CMS.

    WhoIsPete, Cell phone compainies who give away free phones don’t make money on the phones.. Yet they make Billons on the Service… Do you think 6 months of free use and years of service fees is FREE!!!!..  I’m sure there is a contract attached to this donation sort of like a Cell Phone…. Unless you are somehow conjoined to these people, How can you defend them???

    Charlie Longo, you need to stop letting yourself be used by cowards to do their business.  People talk to you cause you’re a nice guy, but you’re being used.  You’re always willing to listen to people, however make sure the information you’re being told is right.

    Longo was correct for saying something about the donation.  If there are strings attached - maintainence contracts or service or royalty fees – then the donation is not so free anymore.  Another concern is that the free software will be embedded and or instilled in the daily use of city operations that it will cost more to replace it then pay a service contract with Sutherland-Weston.  Beware of Greeks bearing gifts.

    I stand behind my previous statements.  It may not be a legal dilemma, but I believe it is more in line with a persons ethics and the oath I swore as a councilor.

    That is right Charlie. So many councilors get on the council for personal gain. They claim it is because they want what is best for Bangor but so quickly become so transparent. How many city accounts did sutherland and weston have before he became councilor? After? How many did WBRC have before John Roman became councilor? After? The proof is in the pudding my friend. WBRC was gross in the way they handled business in Bangor, heck, they got every contract they bid on. Weston will too due to his firms “precious generosity”.

    You keep digging boy and you will be amazed what you find. Just be on the lookout, someone might come to you with a great job offer soon…hush money. Maybe you are independantly wealthy and wont be tempted. Good for you.

    If only Longo had read the law. I read what he posted and it was about gifts to employees, not gifts to the city. Wasting time and trying to make other councilors look bad, great start. Enjoy your one term.

    I still don’t get where you are coming from, and how this is any “personal ethics” issue… 

    If money was changing hands, that would be different- like if a council member had the plow contract with the city, or as was the case with former Mayor Greene when he was getting paid for photography services. No payments that I know of were paid to Sutherland-Weston for this piece of software. If money does change hands in the future, that’s when we should question it.Also, as I understand the situation, the city WAS going to spend nearly $7,000 on an EGov platform BEFORE Weston offered to donate his company’s software in order to save the city money. What’s also not being discussed here is that Megan Collins, the city’s IT person, designed, programmed, and populated the new website for 6 months using this donated software without any payment to Sutherland-Weston. And concerning the argument about “free advertising” that someone made in a comment on that last article… That was non-existent (before you, Councilor Longo, made a big deal about this and therefore brought it to public view) because there is NOT even a link to Sutherland-Weston in the footer of the website (or anywhere else that I can see) as is commonly the case when a company is hoping for “free advertising”.

    The bottom line, if this software was from Longo or one of his college roommates, we wouldn’t be hearing anything about it…

    Actually its councilor  Joe Baldacci who is behind the controversy with the Waterfront Concerts.   The controversy WABI announced tonight has cost them  one concert with James Taylor which will now happen in Portland at the Cumberland County Civic Center.  This is just more of the foolishness and what has been wrong with Bangor City Hall for many decades.   It’s time for Bangor residents to clean house and put good people in office.
