Landlord accused of attempted rape

LINCOLNVILLE, Maine — A woman’s request to have a protection order served against her landlord resulted in his arrest on charges related to an attempted rape that allegedly occurred about a month ago.

Augustine Fernandez, 41, who lives on High Street in Lincolnville, is accused of forcing himself on the woman and attempting to have intercourse with her, Lincolnville Police Chief Ron Young said Wednesday.

The woman told police that Fernandez, with whom she once had a “semi-relationship,” had in mid-June picked the lock of the door to a room in the house they shared, Young said.

“He was completely naked at the time,” the chief said.

Fernandez allegedly went into the room, restrained the woman and tried to rape her. She told police she was able to block the attempted rape.

“The reason she didn’t come forward right away is — she didn’t know what to do,” Young said.

The woman’s teenage daughter also was at the residence at the time of the incident, the woman told police.

The woman initially went to the Waldo County District Attorney’s Office to obtain a protection from abuse order against Fernandez. But Young said that on July 5, when he saw the narrative she had written for the judge, he noticed there were several felony crimes detailed within it.

“I sat down with her and had her explain everything,” Young said.

When the chief spoke with Fernandez about the alleged rape attempt, he “lawyered up” immediately and refused to talk about it, Young said.

Because Fernandez is being accused of felony crimes and domestic violence, he was arrested.

“[In] domestics, we shall arrest, regardless,” Young said.

Fernandez, who otherwise has a “very minor” history with police, was charged with felony burglary, felony unlawful sexual contact, unlawful sexual touching, domestic assault and aggravated criminal trespass.

He was arrested without incident on July 6 and booked at Waldo County Jail, with bail set at $2,500 cash or $25,000 surety. Fernandez was released July 7 on the cash bail. He also was served with a protection order that forbids him contact with the alleged victim.

Fernandez is scheduled to appear at Waldo County Superior Court in Belfast in late August.

    Eventually, your question may be answered when this goes to court. NONE of us know the answer as to why she didn’t move out….except her! She should be able to feel safe, no matter where she lives….and no one should be FORCED to leave their residence because they feel unsafe!

    She didn’t wait a month. The story says mid-June. She probably went to the court and the clerk gave her the standard form and instructions. She fills it out and files it with the clerk. It gets put in the judge’s in basket. The judge looks it over and signs the order. She has to come back and get the signed orders. She brings a copy to the local PD to be served. July 5th (the day after a holiday weekend) the chief is reading it and decides to look into it further.

    I would not live with some horrible man that wants to rape me in HIS home. That does not make sense to not contact the police and to continue to live with him.

    Sounds like since he went to jail and now can not have contact with her that he most likely can not live in his home. Well isn’t that convienent.

    Yes, it would be interesting to hear the WHOLE truth, however, we never will since the Chief of Police has charged her Landlord with Domestic charges. There is a contradiction there that you don’t seem to understand.

    If he is guilty then he deserves what he gets, if she is lying then she should be charged.

    perhaps she was too poor to move. Perhaps he refused to return her security deposit; it would be very easy for a landlord to make this woman unable to move.

It wouldn’t have mattered though because even if he lived there and was married to her, he could still have raped her. It happens all the time. The victim might not have been able to move even if she felt she was in danger due to the fact that she could not afford to relocate. She didn’t report the rape til now because she did not know what to do; she most likely assumed that if she went to the police saying that a man she had a former relationship with had raped her, they wouldn’t believe her. Why would she believe such a thing? Well its because rape victims are seemingly the only victims that are blamed for being raped. We need to stop blaming the victim, and we need to stop making assumptions about the assailant. I am in hopes that they recovered some physical evidence of the crime in order to prosecute the correct person.

    I was falsely accused of harassing a woman and even pinning her against a wall.  This was supposedly going on for months before she reported it.  Never mind the fact that I’m gay and *I* liked to be pinned against a wall!  (tee-hee!)

    In a situation such as this, people are going to react differently, because everyone is different. I don’t think there is a right or wrong answer to “why didn’t she move out?” If this question were asked of me, I would say…..”I don’t know.”

    I appreciate your point, I really do.  But it’s also a crime that can ruins a man’s life simply by being accused and charged – because of the stigma and stereotyping of men.  Sadly in the past women were often ruined simply by coming forward.

The use of the word “landlord” can mean that he had an economic advantage over her. I’ve known people both male and female who got into a domestic situation where the other person was the owner or the only person on a lease. They put some money into it and sometimes they even put up half of whatever the other person had already paid out in apartment and utility deposits. When the relationship went sour, they were not in a position to pack up and move out immediately. It’s not as easy as some people might think.

    It sickens me that people automatically assume rape victims are lying.  That being said, when someone IS falsely accused I think the accuser should face the same penalty the accused would have received if convicted.

    Two words, Duke lacrosse. We shouldn’t assume she’s lying, just as we shouldn’t assume he’s guilty. The emotions she displays in the courtroom can hardly be considered as evidence. The idea that no woman would ever falsely accuse a man of rape, quite frankly, is absurd.

    Hi Violet, I checked out the site http://www.fillerfund.com and I will say that this is very sad. What really upsets me is that the DA’s are more interested in winning cases and supporting law inforcement regardless of the accused actually being guilty. The system is truly flawed and I believe alot of attorneys/DA’s are in it for the money and their super inflated ego. It should be about true fact finding. I image this man spent every last penny he had or did not have a good defense because of lack of money. In the meantime while his disgruntled wife accuses him of everything under the sun after he wants to split with her I would imagine that mortagages and car payments and bills to support a household and children were not being paid. They both suffer for this, we as tax payers suffer and the children have no parents.
