Attorney: Mother to seek dismissal of murder charge in death of 10-year-old Marissa Kennedy

An attorney for the mother of a 10-year-old girl killed in February 2018 said she will ask the state to dismiss murder charges against her, if the girl’s stepfather pleads guilty.

In response, the attorney for the 52-year-old stepfather, Julio Carrillo, called that move a “ridiculous attempt to generate headline,” according to the Associated Press.

Sharon Carrillo’s attorney, Laura Shaw, said Tuesday that Julio Carrillo’s expected guilty plea should change the situation for Sharon Carrillo, who is charged with depraved indifference murder as a result of the child’s death.

“We are hopeful that the prosecutors will dismiss the charge against Sharon Carrillo, and believe that the prosecutors should do so now that Julio has taken responsibility and pleaded guilty,” Shaw said.

She and Christopher MacLean of Camden are representing Sharon Carrillo. Jury selection for her murder trial is scheduled to begin in December, unless the state drops charges.

A phone call to Julio Carrillo’s attorney, Darrick X. Banda of Augusta, was not immediately returned.

Authorities allege Marissa Kennedy died in Stockton Springs after being beaten for months by her mother and stepfather, who tried to make her death look like an accident. Sharon Carrillo subsequently told investigators that her husband had abused her and the child before the child’s death and that he coerced her to claim equal responsibility for the crime. His attorney has denied that assertion.

Julio Carrillo is expected to plead guilty next Monday to depraved indifference murder in Kennedy’s killing.

Sharon Carrillo previously pleaded not guilty to the same charge.
