ROCKLAND, Maine — Bail was set Wednesday for a couple who police say assaulted the woman’s mother after she ordered them to leave over their drug use.
Michael Humiston, 26, and Shannon Gagne, 29, made their initial court appearances in Rockland District Court. Humiston is charged with aggravated criminal trespass, criminal mischief and assault. Gagne is charged with domestic violence assault and criminal mischief.
Judge John Lucy set bail at $750 cash for Humiston and $500 for Gagne. They remained at the Knox County Jail Wednesday afternoon.
The couple was staying with Gagne’s mother on Aug. 15 when the mother ordered Humiston to leave after she suspected he was sharing his prescribed Suboxone with her daughter, according to Assistant District Attorney Christopher Fernald. She then told her daughter that she had to undergo drug treatment or leave.
Later that night, according to an affidavit filed by Rockland police, Shannon Gagne asked her mother to let Humiston return. The mother refused, at which time the daughter punched her mother five to six times. The daughter also broke her mother’s telephone, according to the affidavit. The mother was able to stop the attack when she pulled out a canister of pepper spray from her back pocket and threatened to use it.
Humiston then broke down the locked front door and pushed the mother to the floor, according to police. The daughter kicked her mother several times while she was on the floor.
The couple left before police arrived and warrants for their arrests were issued. Humiston was arrested Monday night and Gagne Tuesday morning. Both were taken to the jail in Rockland.
The prosecutor had sought higher bail for both defendants, citing their criminal records. Gagne has a criminal mischief conviction from 2003 in which the victim was again her mother. He said she also failed to appear for a court hearing as a witness in a case. Humiston has convictions for perjury, carrying a concealed weapon, aggravated criminal mischief, theft and burglary from a motor vehicle, Fernald said.
Fernald had asked for $1,000 bail for Gagne and a higher amount for Humiston.
