Bangor man arrested after refusing to turn down stereo

BANGOR, Maine — A Cedar Street man who was blasting music from a portable stereo Tuesday morning was arrested after refusing to turn down the music and yelling obscenities at responding officers, Bangor police Sgt. Paul Edwards said Wednesday.

A neighbor called police at 10:50 a.m. to report the noise. When Officer John Robinson arrived, he “reported that he could hear the stereo from the sidewalk and that the noise was coming from the back of the home and was unreasonably … loud,” the sergeant said.

Robinson walked to the back of the house and found the stereo on the ground. Loud music was coming from it and no one was around. The officer found the homeowner, Joseph Sharkey, 48, who “was immediately angered by his presence and claimed he was not going to turn the stereo down,” Edwards said.

Sharkey began swearing, directing his anger at the neighbor, the sergeant said, adding that the man and his neighbors have had disputes in the past.

Robinson warned Sharkey repeatedly that if he didn’t turn down the music, he would be charged. After Sharkey refused, Robinson decided to take him down to the police station to charge him. The officer turned down the radio.

“Sharkey walked over and turned it back up while continuing to yell obscenities,” Edwards said.

Officer Ed Mercier arrived to assist, and both officers told Sharkey that if he turned down the music and signed the disorderly conduct ticket they would leave. But he refused and was arrested for disorderly conduct and failing to sign a criminal summons, Edwards said.

Sharkey was taken to the Penobscot County Jail and later released.

Noise complaints are most common at night, but police respond no matter what time of day it is whenever noise is excessive, Edwards said.

“It doesn’t have to be at night,” he said.
