Bangor police arrested a Brewer man on a felony theft charge Tuesday afternoon after he allegedly left a Bangor convenience store with cigarettes he had not paid for.

Daniel Ruggiero, 34, reportedly went to the Circle K convenience store on Odlin Road about 2:30 p.m. and asked the clerk for three cartons of cigarettes, valued at $208.56, Bangor police Sgt. Paul Edwards said Wednesday.

As the clerk was entering the purchases into the cash register, Ruggiero swiped his bankcard in the store’s scanner and left the store on foot with the cigarettes in hand. Shortly after that happened, his card was declined.

Edwards said Ruggiero was seen heading toward the Econo Lodge Inn & Suites, which is where police officers located him and placed him under arrest. Edwards said Ruggiero likely left the store quickly because he knew his card would be rejected.

Edwards said the theft charge was elevated to aggravated because Ruggiero has prior theft convictions from 2005 and 2006. Ruggiero remained at Penobscot County Jail late Wednesday night, a jail official confirmed.
