Sangerville man pleads guilty to 16 sex charges

DOVER-FOXCROFT, Maine — A Sangerville man accused of multiple counts of unlawful sexual contact and sexual misconduct involving three children ages 14 and under pleaded guilty Monday in Piscataquis County Superior Court.

While Daniel H. Smith, 65, told Justice William Anderson that he hadn’t done all “that stuff” outlined in the 16 counts, he still pleaded guilty to the charges and to one count of assault. Smith said he had no witnesses to dispute the charges.

The incidents occurred in 2003 and 2004 when the boys were 13 and 14 years of age. Smith was a school bus driver at the time.

Anderson was patient with Smith in the courtroom and asked him repeatedly whether he understood the court process and the fact the state would have to prove the charges beyond a reasonable doubt. He also asked Smith at least twice whether he was making the plea voluntarily, to which Smith replied he was.

Randy Day, Smith’s attorney, also told the court he had discussed the process with Smith.

Another hearing will be held in the future for sentencing Smith on the charges.

Piscataquis County District Attorney R. Christopher Almy has recommended three consecutive prison terms of 10 months, six months and four years in prison with all but one year suspended and three years’ probation for the crimes and to reflect the predatory nature of the defendant’s conduct.

Almy said Monday in court that the charges stem from Smith’s touching a young relative’s genitals with his hands. He also did the same kind of touching with two of the young boy’s friends, according to Almy. Smith showed the boys pornographic movies in an effort to show them the behavior was normal, he told Anderson.

When Smith’s younger relative learned that Smith had touched the genitals of another one of his friends, he confronted Smith and told him to stop. That confrontation ended in a physical altercation, Almy said.
