Bail set at $250 for Rockland man accused of covering woman’s face with pillow during argument

ROCKLAND, Maine — A judge set bail Monday for a Rockland man who allegedly covered a woman’s face with a pillow during an argument. The amount was considerably less than what the prosecution had sought.

Judge Susan Sparaco set bail at $250 for 28-year-old Joshua Smith on charges of felony domestic violence assault and criminal mischief.

Assistant District Attorney Christopher Fernald had requested that bail be set at $5,000 cash. He said that while all domestic violence assaults are serious, he considered this one to be particularly so. The prosecutor also cited Smith’s criminal conviction for criminal threatening and assault in 2006 for making the current charge a felony.

An affidavit filed in Rockland District Court by police states that police were called to a Warren residence Friday. When officers arrived, they spoke with the alleged victim who said she and Smith had been arguing for the past two weeks, and it escalated Friday. She told police that Smith at one point took a pillow and put it over her face. He then got up and smashed a box fan belonging to her, according to the affidavit.

Attorney Jeremy Pratt, representing inmates for their initial appearances on Monday, said Smith has mental health issues and is on a waiting list for services at Midcoast Mental Health Center. He said that Smith’s only source of income is Social Security disability, and he asked for bail to be set at $100. Pratt said if Smith is held for more than 30 days, he would lose his benefits which he uses to support his three children.

Sparaco said that while $250 was not much bail for a felony offense, it was a lot of money for Smith.
