Lewiston registered sex offender facing federal child pornography charges to be held without bail

PORTLAND, Maine — A federal judge Wednesday ordered a registered sex offender facing child pornography charges held without bail.

Fredrick W. Butler Jr., 44, of Lewiston was indicted last week by a federal grand jury on two counts of transportation of child pornography in April and one count of possession of child pornography in September.

Butler is required to register for life on the Maine Sex Offender Registry due to two convictions for gross sexual assault in Maine and one conviction in federal court in Portland in 2001 for knowingly receiving child pornography.

He was sentenced in 2001 to 6½ years in federal prison followed by five years of supervised release by U.S. District Court Judge D. Brock Hornby, according to information posted on the federal court’s electronic case filing system. During his supervised release, Butler was ordered to wear an electronic ankle bracelet and was confined to his home, according to court documents.

It does not appear that Butler was on supervised release when arrested earlier this month.

Butler was arrested on Nov. 7 and pleaded not guilty to the charges the same day in federal court in Portland. He is accused of sharing and saving files on his computer “depicting sexually explicit conduct that were produced using minors engaged in sexually explicit conduct.”

U.S. Magistrate Judge John H. Rich III concluded that no bail conditions could be fashioned for Butler that would assure the public’s safety, according to court documents.

If convicted, Butler faces between 15 and 40 years in federal prison due to his previous convictions for sex crimes on the transportation charge. He faces up to 10 years on the possession charge and could be fined up to $250,000 if convicted.
