Driver in fatal ATV accident arrested in Mass., will be returned to Maine for trial

NANTUCKET, Mass. — A man who had a warrant out for his arrest on a motor-vehicle homicide charge stemming from an August 2012 all-terrain vehicle accident in Naples that killed a 24-year-old woman has been arrested in Massachusetts.

Don Hart of the Nantucket District Court in Massachusetts said Monday afternoon that Jonathan N. Caswell, 28, of Nantucket has been turned over to the Barnstable County Sheriff’s office for return to Maine.

Caswell was arrested Sept. 18 by Nantucket police and charged with resisting arrest, driving with a suspended license, an open container violation and being a fugitive from justice. All the Nantucket charges were dismissed in Nantucket District Court on Monday morning after Caswell waived his right to rendition, said Hart. He has been turned over to the Barnstable County law enforcement for extradition, said Hart.

“It was pretty cut and dried,” said Hart. “We want to get him to Maine as quickly as possible.”

Hart said Barnstable County officials will contact Maine police officials to make the transfer.

Caswell was the driver of the all-terrain vehicle that killed 24-year-old Shanan Loud of Naples. The Cumberland County Sheriff’s Department said at the time the woman and Caswell, then listed as a Naples resident, were riding on the ATV on the River Road without a helmet when it went airborne, flipped and landed in the Crooked River. She was pronounced dead at the scene.
