Man convicted of ’03 manslaughter arrested on domestic violence assault, obstruction charges

BANGOR, Maine — A Bangor man who was convicted of manslaughter in York County in 2003 was arrested by Bangor police Tuesday on charges of domestic violence assault and obstructing the report of a crime or injury.

In addition to those charges, Benjamin L. Humphrey, 40, is charged with violating the terms of his probation, which prohibited him from consuming alcohol, according to documents filed Wednesday at the Penobscot Judicial Center.

As of Wednesday night, Humphrey remained at Penobscot County Jail, where he is being held on a probation hold, a jail official confirmed. Bail for his new charges was set at $500 cash.

According to published reports, Humphrey and his sister Angela Humphrey were convicted in 2003 in connection with the slaying of a Canadian tourist, Derek Rogers, 47, of Russell, Ontario, in Old Orchard Beach the previous July.

Rogers was suffocated with sand after being severely beaten. His body was found by a fisherman on the beach in the Ocean Park section of Old Orchard Beach on July 31, 2002.

Humphrey, who initially was charged with murder and perjury, ultimately pleaded guilty to manslaughter just before his trial was slated to begin in York County Superior Court. In pleading guilty to the lesser charge, Humphrey was sentenced to 20 years in prison with all but five years suspended and six years of probation.

His arrest in Bangor on Tuesday night occurred after he allegedly assaulted a female household member and then took her phone in an attempt to prevent her from calling the police, according to court documents.
