Man accused of sexually assaulting 14-year-old girl reportedly is father of her child

ROCHESTER, N.H. — The man indicted on a felonious sexual assault charge earlier this spring reportedly impregnated a girl who was too young to give consent to sexual acts, police said Tuesday.

Justin Sanchez, 22, formerly of Sanford, Maine, and now an inmate at the Strafford County jail, is being held on $10,000 cash bail after his indictment in March.

His felonious sexual assault charge, in the category of statutory rape, alleges he had sex with a 14-year-old girl between July and August of 2011. The official charge against Sanchez states the offense allegedly occurred on Norway Plains Road.

Police Capt. Paul Toussaint said Tuesday the sexual act resulted in a pregnancy and the birth of a child.

“This is essentially sex with an underaged person,” said Toussaint.

He said that Rochester police began their investigation behind the matter in October 2011, after they received a tip from Sanford, Maine, police. After an investigation by Rochester police, with assistance from the Division of Children, Youth and Families, Sanchez was arrested on Dec. 11, 2012. On Tuesday, Toussaint could not provide an explanation for why it took more than a year to make an arrest.

The day after the arrest, Judge Daniel Cappiello of Rochester Circuit Court gave an order of protection prohibiting Sanchez from contacting the alleged victim, who is now 15 years old, as well as an infant boy, who recently turned 1.

On Dec. 20, Sanchez was placed in the bail supervision program with the Strafford County Community Corrections Program, and on Dec. 28, he allegedly violated his bail conditions by contacting the alleged victim in the case. After the violation, he turned himself in to police and was arrested in January on a stalking charge, said Toussaint.

A preliminary pretrial conference for the felonious sexual assault charge has been scheduled for 9 a.m. June 4 at Strafford County Superior Court.

If Sanchez is convicted of the felonious sexual assault charge, a Class B felony, he could be sentenced to three to seven years in state prison, and a $4,000 fine.

Sanchez is now listed in court documents as being a Boston resident.
