Lawyer facing child pornography charge suspended from practicing

BANGOR, Maine — A local attorney indicted last year for allegedly having child pornography on his computer has been suspended from the practice of law.

Richard D. Violette, 53, of Bangor was suspended temporarily for illegal conduct, improper communication and conduct involving dishonesty, according to information posted on the Maine Board of Overseers of the Bar website.

The suspension was announced Monday.

Efforts to reach Bar Counsel J. Scott Davis were unsuccessful Tuesday morning.

Violette is expected to plead guilty Friday at the Penobscot Judicial Center to one count of possession of sexually explicit materials, a Class C crime, according to the Penobscot County district attorney’s office.

Investigators found child pornography on computers seized from his Broadway home in April, Michael Roberts, deputy district attorney for Penobscot County, said in November after Violette was indicted.

Bangor police began investigating Violette after another law enforcement agency linked his IP address to the downloading of known child pornography, Roberts said.

No evidence was found that Violette produced the images or used them to meet children online or in person, according to the prosecutor.

Violette does not have a criminal record, according to the Maine State Bureau of Identification and Criminal History Record, but was been reprimanded in 1991 by the Board of Overseers of the Bar for his actions with a minor, according to information posted on the board’s website. Violette acknowledged that he had given a minor alcohol, according to a previously published report.

Violette was reprimanded again in January 1996 for failing to file an appeal on behalf of a client who was sentenced to 12 years in prison on a drug conviction in 1985.

If convicted on the child pornography charge, Violette faces up to five years in prison and a fine of up to $5,000.
