    The police do not have the right to hold the names of criminals and release others.. That is the DA’s job and they got ordered to release them.

        Strange that when people are charged with other crimes, OUI, assault, theft, their names make it into police beat or other stories long before they have a trial. But not this time, must be some powerful names on that list,

          The live-&-let-live Let it Be side of me says “who cares.”  You cite an excellent example of a person in the public trust. (That was the story that prompted me to start checking into this site semi-regularly, which I’d rarely done previously.  It seems that sometimes the comments fill in the blanks of certain articles which is an interesting dynamic in itself.)  Not sure about your warning regarding beware of Christians, but the overall sentiment is appreciated & understood.  Now I have to find a way to scrub SWIM off that list…

       As long as there is an appeal pending before the Supreme Court, they Police cannot release the list.  If they were to do so, and the Court ordered the names sealed, the ruling would be moot, and the Police would be facing lawsuits.  Not to mention the same people on here crying foul for not releasing the information, would undoubtedly be on these blogs crucifying them for doing so.

             Schwartz filed for an injunction until an appeal could be filed, heard and ruled upon, Judge Janelle said no to that, so legally the names can and should be released.  Burpee is an officer of the law not a judge.  Seems he should be upholding the ruling of the judge given that is his job. 

          • Bottom line is the names are not going to released at this current time. Yes, I want them released but give it time.

        Court in Portland. A Supreme Judicial Court official said late Friday afternoon that no appeal had yet been received.
        As you can see, there is no appeal pending.
        Someone must have something to hide.

           The PPH reported that the district court denied the applicant’s motion for a stay (of its judgment denying the injunction) pending appeal.  If there’s no stay order from the SJC (and if an appeal hasn’t been filed, there’s probably no stay order), the only thing standing in the way of disclosure is the prosecutor’s discretion.

        The story says the supreme court hasn’t received the appeal yet, so yes the police are over stepping there bounds, Also the court ordered the list unsealed and released..

      NOT releasing the names is wrong!!………………… when a JUDGE made a ruling, to have those names released. No wonder people are believing in a more  and more lawless society.;double standards are causing a decay in society!! The John”s did the deed, why do they think they need protection? Who  do they think they are? We know people with money, but that does not make them SPECIAL  nor receive special treatment!!! should they. the female hooker ring leader is plastered all over the TV and newspaper!! Come on.         One of the foundations of our judicial system is that people are innocent until proven guilty. Regardless of who you think they are, do they not deserve this basic American right?

          Disagree. The press always reports the names of “suspects” BEFORE a court decides they are GUILTY. It sells newspapers. Plain and simple. You know that.

          The same will happen here. By releasing and reporting the names of the “Zumba Johns” is going to sell lots and lots of newspapers, because people want to know this information and the press has a duty to provide it, because they are the eyes, ears and voice of, we, the people. Read the Constitution.

          If the police, themselves, are on that list, and I suspect they are, then the public, through a free and open press, needs to know it immediately and respond, for their own protection, accordingly by seeking their immediate removal and police replacements, of course.

          In the meantime, I am going to be driving without a license until my appeal from the District Court, where they found me guilty for reckless driving, has been reviewed in Superior Court. Only then, using Kennebunk Police logic, will I accept the initial, District Court’s ruling to take away my license….??? According to Kennebunk Police, I’d be right….. Right?

          And, that is exactly what the police, here, are saying? …. Obvious, Judge pickers the lot of ’em.

            Umm, let me get this straight; you suspect the client list includes police officers and that’s why it’s not being disclosed? When it’s the police and DA that are trying to release the names? I think it’s a heck of a lot more likely that there are politicians and wealthy folks on that list and that’s why the release is being fought tooth and nail. Once a cop hater, always a cop hater, I guess, huh?

            One doesn’t have to be a cop hater to “suspect” anything since its been reported on the TV news multiple times that the client list includes the names of law enforcement officials as well.

            No. I am no “cop hater”. I respect the good ones, which are most of ’em. But, as I understood the article, Lt. Antony,  some “Cop” or other, was making the decision not to disclose until the appeal is heard here.

            But, and I think I am speaking for the majority posters here when I say that, all that people want is to review the darn list themselves. It’s possible that the list does not net any surprises.

            Either way, this is gonna be good to see resolved in favor of publishing the list.

            Its also possible that a lotta hypocrits, so called “christians”, evangelicals and other freaks are gonna be exposed and it will serve ’em right. …. I calls it justice when the blamers and accusers, the one’s that cast the ” first stoners”, are exposed. Yup….. gonna love this.

            This is G.W. and Ted Hagerty all over again, local style.

           An ADULT charged with a crime is public record so why would the charges be tossed out? Their arguments are ludicrous and the same could be said about ANY person charged with a crime. It is no different from any other case period. The names should have been made public as they were charged.

    •  yes they do. they can ONLY release those that are charged with a crime. And only those that they have ON video doing something are gonna be charged. Just being on the list without any other cooperating  evidence is not gonna get them charged. Any Ahole can write someones name on a list. Publishing the whole list without other evidence is a good way to get the crap sued out of you and rightly so.

    I would bet if the DA’s Office knew ahead of time about the list, no one would have been charged. They puffed up bragging about the arrest, now the want out of it.. The judge should hold the police chief in contemp of court and demand all messages sent to them.

    Plaintiffs will suffer irreparable harm if their names are released to the media?  Allowing them to exercise selective releasing of names of law breakers, really, if this is not brought to the public, the Maine System of Justice will have no integrity, and, in an open unbinding appeal,
    cause and claim must be not determined by law breaker, breakers, being in a possible infidelity,
    or contemptible situation relative to the public or private, but determined by statue.

      It seems that every time someone  commits a terrible crime authorities quickly add the full middle name. Lee Harvey Oswald, Jared Lee Loughner, John Wilkes Booth, Mark David Chapman,or James Earl Ray etc. Obviously the police want to quickly take the innocent off the hook from unwarranted suspicion. It will be interesting to if that happens in this case. If you are David Johnson for example-there’s more than likely several  of you in Southern Maine.- But, honey that ain’t me!

    I find it rather odd that whenever there is a someone arrested for prostitution the woman’s name is always released with pictures, but never her ‘customer’s’ names…….gee I wonder why THAT is?

    Despite the ruling, Lt. Bean Burpee said Friday afternoon that the Police Department would not be releasing the names until the appeal has been acted on by the high court. Lt. Bean Burpee said the appeal to the state high court was filed in Biddeford District Court and will be sent to the Maine Supreme Judicial Court in Portland. A Supreme Judicial Court official said late Friday afternoon that no appeal had yet been received. The names of the two people being represented by Schwartz are named John Doe 1 and John Doe 2. “Plaintiffs will suffer irreparable harm if their names are released to the media by the police,” Schwartz stated in the appeal filed Friday in Biddeford.

    wonder if the videos will be admissible? if not the list will mean nothing. charges will only be brought up against strong and wright for taxes and invasion of privacy.the johns will walk. i could make up a list of any names i want but without a paper trail (credit card transactions,checks etc.,) it means nothing.

    This is all a great big misunderstanding. These 100 or so folks thought they were going to a restaurant.  Zumba is so close to Zuppa-an Italian word for SOUP or CHOWDER. Most of these customers at the Italian eatery stayed about half an hour-more than enough time to have a heart warming experience. All Mainers love a good soup or Chowda!

    If a crime was committed that involved more than one person, then the public has a right to know the names of all parties involved. It’s just as illegal for a person to solicit a prostitute’s services as it is to solicit a john’s money. So unless any of these upstanding citizens is underage, let’s see the roster of names.

      However…maybe prostitution should be legalized? Then the women (or men, as case may be) would not have to operate outside of police protection.

    For some of us our position in society dictates the severity of legal responsibility confronting our trespasses.  

  • Some jurisdictions hold the “john” legally responsible in prostitution cases as well as the alleged prostitute and any “agent”.  Evidently Maine does not.   If Maine is really determined to fight prostitution, it seems like they should also hold “johns” liable as accomplices in the crime.  Governor, how about jumping on this?  It should be worth a front page story.

    On a more serious note.  If there is no blockage from the court then they should not be holding public information.  So before they get another judge to issue a gag order someone should be asking for rellease of the information in accordance with title one chapter 13 of the maine revised statues.  Good luck all

    The guys who have requested an injunction must expect that prosecutors won’t actually follow through and prosecute their cases, because this procedure and appeal to the SJC is otherwise just a delaying tactic.  The names of men actually charged in the district court are bound to come out once their cases are scheduled for arraignment and trial.

    In fact, what’s to prevent a news reporter, or any other person, from going to the Clerk’s office at the Biddeford District Court Monday morning and examining the docket and other filings for the names of people charged with engaging a prostitute?

        That’s what I think, and the court could not stop the press from publishing the names and the charges. 

        Really, there’s just no contest when you think about the competing interests and throw them on the balance:  First Amendment freedom of the press v. a criminal defendant’s interest in not being embarrassed.

    If it is considered a crime, release the name of the John’s, as well as the names of the Jane’s, just as everyone does when its a man suspected of an unwanted sexual affair with a woman. Those who can afford to satisfy their sexual desires with many ladies (Some call the by other names), are very well off, and hold high positions, so do not really expect to see those names any time soon, or at least until after a few names are removed. Our damn legal system is totally corrupt.
    If our forefathers were still around they would have serious problems, but our current crop of sheep, along with the ‘politically correct society’ just do not care. Many fought and died for the freedoms we are giving up willingly.

    Why is it that every other business can video tape everything every where in and around their business, yet it is a crime for her to do so?  Also if she for any reason would have been assulted or killed durning the act of selling sex, would that tape been admissable in the court to prosecute the villian?.. You see it doesn’t matter how they try to twist it, the police often use  video tapes of a crime in court to prove the perp was guilty.. Boy they want it both ways..

    The release of these names is important. It has to be done.. It is a serious matter..It is very dangerous to protect the powerful yet have the ability to extort them.. When the Police and DA’s office know a politicans(rule maker) or judge is on the list then that position can and will be compromised. That is why they all need to be exposed, besides I would take great pleasure in seeing the powerful fall

    I have always believed that prostitution should be legal but it isn’t.  The press has no problem releasing the name of the alleged prostitute and the ‘white haired bearded dude’.   What’s good for the goose is good for the gander.   Everybody else who commits a crime has their pictures splattered all over the paper and news.   I am concerned most with the fallout the families will have to endure; they will need support and compassion!

    Mr Strong was, allegedly, astute enough to not only rent the space for this enterprise, but to arrange to (secretly) video tape the sexual encounters, producing a product that is highly marketable, and profitable, on the XXX video market these days.

    One does not have to think about all of this for very long before you realize that “prominent”, “often wealthy” citizens could be another source of highly profitable activity……………blackmail!  This does not seem to have ocurred to the authorities……………yet!

    The fact that at least one person is connected enough to keep their names quiet at the moment, would indicate that there may well be some pretty big fish in this pond.

    The Judge has declared the law and the police in Kennebunk, Maine are BREAKING IT.

    I think it is kind of neat that the Police can pick and choose what laws to obey. I suppose that means when I get my license suspended by a District Court that I can still keep driving until my appeal to the Superior Court is determined? NUTS!

    These guys are just, plain stupid, or taking orders from some pretty powerful, extrajudical forces behind the scenes. Fire ’em.  Fire ’em all.But, let’s see, who could those forces be? Hmmmmmmmm …. Kennebunk, Maine….HmmmCould it be!  No way…….. Wanna bet G.W. and his dad areon on that list? Anyone?Read the Franklin Credit Union of Omaha stories and how the old man liked to host Boy’s Town abductees at the White House for sex parties.

    I am looking forward to carefully parusing that list over in detail …. I  mean, name searching, bios, etc…… Yeah …..

    So, the judge saw the list of names.. There must be someone “pretty important” on that list for them to be withheld…IMO any spouse of those involved should have the right to know immediately in order they could be tested for diseases they might have contacted from their lying cheating dirt-bag husband.

    I for one would like to see the names on that list.  But that would be for my own entertainment, I suppose one could say.  That said, I think the names should NOT be released. I would like to know if there are elected officials, judges, cops etc. but there are going to be too many innocent victims, i.e. wives and kids of these johns. These guys made a serious mistake and if the names could be released without hurting others, I would be all for it.

    My late husband made some mistakes and his name was printed in our local paper and parents wouldn’t let their kids play with mine etc. so I know, personally, how this can hurt the most innocent of victims. So to protect those who need the most protection, I can forego knowing the names. Who is with me?

    This isn’t Sesame Street and all that rattling about should/shouldn’t  is just so much hot air.     Wouldn’t at all surprise me if that Dear Johns list somehow gets lost or destroyed before it gets into the courtroom.  The court and PD and DA are all part of the city, as are some folks on that hit list, and everybody is gonna think long and hard (oops!  LOL) about destroying the lives and reputations of the people involved.
