Lawsuit dropped against Rockland law firm

ROCKLAND, Maine — A lawsuit filed last year against a Rockland law firm has been dismissed although details of any settlement are not being revealed.

Evelyn A. Donnelly of Rockland filed the lawsuit in July against Strout & Payson, P.A., and attorney Eric B. Morse, claiming negligence in the handling of her divorce settlement more than two years earlier.

The case went to mediation and in January the matter was fully resolved, according to paperwork filed with the court.

This week in Knox County Superior Court both sides filed a stipulation of dismissal.

Attorney Robert Rubin of Rockland, who represented Donnelly, declined comment on the case.

A telephone call was left with the law firm’s attorney Theodore Kirchner of Portland.

In the lawsuit, Donnelly claimed her attorney failed to discover the full extent of the assets of her husband Kerry Altiero, which included Rockland restaurant Cafe Miranda and real estate in Owls Head, and that based on Morse’s advice she settled for no child support and no spousal support.
