Brewer man sentenced for stealing mother’s benefits after her death

BANGOR, Maine — A Brewer man was given a six-month prison sentence and ordered to pay $69,357 in restitution during a sentencing hearing Tuesday in U.S. District Court.

Joseph R. Lebard, 57, also was sentenced to three years of supervised release, according to U.S. Attorney Thomas E. Delahanty.

Lebard pleaded guilty on Aug. 19, 2011, to theft of public money, Delahanty said.

According to court documents, Lebard’s mother received workers’ compensation survivor benefits after her husband’s death in 1989. Before she died on April 10, 2006, she was living with her son at a residence in Bangor and was receiving $1,100 a month in survivor benefits.

The U.S. Department of Labor continued to mail benefit checks to her address until about September 2010. Court documents state that Lebard forged his mother’s name on the checks mailed after her death. He then mailed the checks to a bank with a note that also bore a forged signature directing that the fund be deposited in accounts that he maintained at the bank.

Lebard’s conviction is the result of a joint investigation that involved the U.S. Department of Labor’s Office of Inspector General and the U.S. Department of Defense Criminal Investigative Service.
