    The neighbors should be grateful that someone tore down the “decrepit trailer” and is building a house that is a bit more plesant on the eyes. Good greif.

        Who does the land belong to the neighbors?  If they don’t want a house there they should make the owner an offer so he can relocate to a place more suitable to the neighbors.  As long as you are not crossing the boundry lines you should make the “rules”.

        Rules that prohibit anyone from building a home on their own property should never exist. Towns want tax money on land you can’t do anything with. Do you see anything wrong with this, or are you one of the neighbors?

          EXCEPT the septic.sewer situation.I dont care how much of a  rule resister you are,do  you want to be drinking your neighbor’s sewage runoff that leaches into your well?

            Good point. But was there a septic system for the trailer? If it was good enough for a 2 bedroom trailer, then it should be good enough for a 2 bedroom house. And by the way, was the trailer there before the neighbors move into their homes?

        • rules only apply to everyone else and not you…you might change your tune if they building next to you and you find out that it affects the value of your property….

        He followed the rules, the town granted him the permit and then the court said he would need to get the permit modified. The ONLY people saying that he can’t build there under any circumstances are the neighbors…

      They have decided that NO ONE should ever build on that .18 acres EVER. I would put the decrepit trailer back there and fill it with cow manure.

    Why the hell cant people build on their own land, its not like he wants to have a bomb factory its a house.

      It’s because the ones we elect know what’s best for us! Afterall, that’s how it was where they came from.

    My town (Lakeville, Ma., pop 6300) has a two acre minimum for a private dwelling. It had been one acre until 20 years ago, and some townies got pretty upset.  If Appleton’s pop is approx. 1300, then a .18 acre plot does seem too small.
    I also remember growing up in the County when a tar paper shack with a stovepipe for a chimney was perfectly acceptable. 

    Times are a changing, for better or worse, like it or not.

    I grew up on a .25 acre lot with a house and 2 door garage and that was plenty of lawn to mow for me.  I could have lived without .7 of it at the time.

    It’s his land, it’s his property, he should be able to do as he wishes with it. The town shouldn’t be complaining, they’ll receive more revenue in the form of taxes. The neighbors don’t own the property, it shouldn’t be any of their business if he wants to build there as long as he’s not encroaching on their property, which he isn’t. I’ve seen homes built on less than 0.18 of an acre. Let this man build, it should be his right.

    The problem may be more of a situation of that the neighbors have their own well and septic.  A 0.18 property will not support both well and septic.  If the town is supplying drinking water or sewage then the property owner is all set.  However most small towns do not offer theses features.   Septic field must be 100 feet from well or adjacent septic systems.

      Good to know….So,does any trailor going into a lot need a septic AND well?

        If the town you reside in does not have utilities for water and sewage, you will need to get a septic system on your property if you wish to flush the toilet.  That being said, you can get a incinolet, wich will burn your human waste instead of flushing it.  You dont necessarily need to have a well for drinking water.  I know of a residence in Franklin that has a large tank outside that collects rain water.

        So yes and no do you NEED.  It is what one normally has if you have a “normal” dwelling in Maine that does not connect to city / town water and sewage.  The well if drilled will have at least one full length of casing into the bedrock, as well as at least 24″ of well pipe will be exposed above ground.

        A septic system will require you to get a soil survey.  A soil surveyor will come to your property for a fee and do a percolation test.  Based on that test the surveyor will then issue a design for that land of what will be approved for a septic install.  You may need to go to your town before installing the septic system and get a “Plumbing Permit”.  This permit is that you have given a copy to your town of the septic system, they will revue it and make sure it is with in the town guidelines.  You will show your permit to the contractor that has given you the best bid for the job in order for them to do the work.

        I highly suggest you get a garage built first and your power and telephone hooked up to that first if you are building a house.  Alas on my construction it took Fairpoint to connect our house 3 months before we had phone after moving in.  Bangor Hydro was 2 weeks.  Still it was a pain to have to go and get gasoline every day just to be able to take a shower (gasoline to feed the generator).

    I think it’s time to abolish the Appleton Planning Board and get rid of of the CEO and turn the duties over to the County. They would know what is best.

    lets face it. there are rules in place to protect everyone. if you dont like the rules then you need to get involved with the town and get the rules changed. the court ruled that the permit should not have been issued, and the home did not meet the towns rules.

    as others have commented, there are reasons to have some rules in place. we see this in every aspect of our lives.  this guy should have to follow the rules the same as every one else.

    see how government creates more government, this is the local version.

    Lot size minimums are discriminatory towards the poor, promote land development sprawl, and is an infringement on our liberty.

    These neighbors ought to mind their own business.  What exactly do they want- for him to tear down his house so they can purchase the empty lot?   The problems we face in this country are directly related to this kind of thinking, which breeds class envy and the fear that Joe down the street has more than he/she does.  People need to worry less about what the neighbors are doing and more about their own problems.
