Charges dropped after homeless man arrested for charging cell phone

BANGOR, Maine — The Penobscot County District Attorney’s office has dismissed charges against a local man arrested over the weekend on theft and weapon charges.

Shaun Fawster, 23, whom police described as a transient, was charged with theft of services as well as carrying a concealed weapon shortly before 12:30 a.m. Saturday after a city police officer found him charging his two cell phones at an electrical outlet outside a Harlow Street business.

At the time of his arrest, Fawster had a folding knife tucked underneath his shirt, according to a police report.

Fawster was taken to the Penobscot County Jail after his arrest. He was released after the charges against him were dropped.

The District Attorney’s Office has discretion over whether charges brought forward by police are carried forward.

    Good!  It couldn’t have been more than a nickles worth of electric, and he had a jack knife (that’s the old name I guess – now it’s a folding knife weapon).

    Since when is it a crime to carry a folding knife?  Can you get a permit to carry a concealed knife?  A box cutter? A rock?  Are we bound to the TSA standards for what we can carry around town?  I’d really like to know, I don’t want to get arrested for having a potentially lethal toothpick in my pocket.

    Thats how they turn you into a criminal. Even though the charges were dropped, they will still show up on his record. Get busted for jaywalking and it will show he has priors. Pretty slick way to haunt someone.

    Actually the concealed weapons charge was dropped because the DA tossed the charges on the primary charge of theft of services. It wasn’t until the very ignorant or very green police officer came upon the ‘transient stealing power from the Cities 120 volt convienence outlet’ that he was able to preform a search of the victim and discover the knife. Without probable cause to search the homeless guy, the concealed knife was thrown out because it was ‘fruit from a poisoned tree’ as they say… KUDOS to the DA, to the officer as Obama would say “You acted stupidly!” Their are plenty of complete and total morons and idiots out there committing felonies all over the place why in the world, would you waste the taxpayers time and money with a poor sad-sack charging his phone.   Smarten up or find another carreer.

Did the Business owner call the police???  How could they file a charge without a complaint???  If someone is driving down the road in their car can the police stop you just to ask for proof of ownership???  How many people have you seen moving out of a apartment, loading a truck??     I’m in favor of providing those little crank style phone chargers along with cell phones to the poor.  Not only would they help the homeless avoid outlet hunting, but they’d get some exercise too!

    Too many transients in Bangor now. Just imagine how frustrating it must be to be a cop dealing w/ this culture that has been drawn here by liberal grant writers.
     Last year three of them built a campsite on my property and none of them were Mainers. They came here from Ct to get housing on us as they were told they could.
      I really would like the opportunity to thank these narcissistic grant writers for ruining my hometown.

    Congratulations to Susan J. Pope, assistant district attorney
    for having some common sense. The guy, if guilty, took less than ten cents worth
    of power from an outlet that could be considered a public outlet as it was on a
    business. A folding knife is what I would call a Jackknife something I could be
    picked up for every day as I carry one in my pocket for utility reasons.

    It’s really heartening to know there is someone in
    Government that still has a sense of what makes sense.

    This type of petty thieft  happens all the time, and it will add up to a substantial loss for a business if allowed to continue.  I worked for a small convenience store that had it hours clearly posted on the door.  The owner came to work an hour early one morning and found a motor home parked next to the building, plugged in to an outdoor electrical outlet!! Whether homeless or driving a $200,000 motor home, stealing is stealing.  Apparently this is a common practice, and if the fellow used that outlet to charge both of his phones on a regular basis, it does add up.

    One question. Why does this guy have TWO cell phones? I don’t know anybody with two. One is usually enough for most people. Good thing he wasn’t driving. Could you just see it. Holding two up to your ears. Gives a new meaning to hands free.

     Your DA has a head on his shoulders in dismissing these charges. I suspect the cop will be having a talk with his supervisor, if he hasn’t already.

    If a business owner doesn’t want anyone using their outdoor outlet, it’s pretty easy and inexpensive to put a locking cover over it.

    The old saying “lock it and pocket the key” If you leave the car open with the keys inside it, than it is your own fault if the car gets stolen. It’s like setting out bait for a bear. Close the breaker if you don’t want someone to use your electricity. If you leave the current open you are inviting people to use it. The actions give consent. Life is a contract.

    These  cops would have a ball at the Boy Scout Camp out in Edington arresting Boy Scouts with their concealed pocket knifes.  Better still they could set up roadblocks at the mouth of the camp entrance and really feel important catching one with a hatchet.

     Less than 5 or 10 cents to charge those two phones?  I guess so!  Here’s a better estimate:  My phone charger is rated at 24 watts.  If we assume 1 hour to charge the phones, that would be about 24 watt-hours or 0.024 kw-hr.  The approximate rate for energy and delivery is around $0.13 per kw-hr.  That comes to less than a penny to charge both phones (0.3 cents each)!

    It is apparent there are to many cops in Bangor. They are afraid to chase real crime and waste tax payer dollars on these survival crimes against whom?

    it costs about .62 cents an hour to run a light bulb, it takes about an hour to charge a phone, which uses a fraction of the wattage a light bulb would. This man stole PENNIES worth of electricity from an unlocked, wide open receptacle. Not only that, he carried a legal pocket knife… probably to defend himself from all the other sketchy homeless in Bangor!
