Jury awards widow $6.7 million in medical malpractice lawsuit

BANGOR, Maine — A Penobscot County jury Monday afternoon awarded a widow more than $6.7 million in a medical malpractice lawsuit against Eastern Maine Medical Center and Dr. Lawrence Nelson, a Bangor surgeon, according to court documents.

The lawsuit was filed in Penobscot County on Aug. 28, 2009, by Paula Braley, 49, of Lee over the death of her husband, Thomas Braley Sr., at EMMC on May 8, 2005 — his 44th birthday and Mother’s Day. Braley Sr. was flown by LifeFlight to the hospital on May 6, 2005 after an ATV accident.

The jury found that Eastern Maine Medical Center, its doctors and nurses, and Dr. Nelson were negligent in the death of Braley Sr. after a six-day trial at the Penobscot Judicial Center.  

The award appears to be one of the largest ever awarded by a Maine jury in a medical malpractice case.

“The family of Thomas Braley, Sr., and his many friends are very thankful and relieved with the jury’s verdict,” Portland attorney John Flynn, who represented Paula Braley, said Tuesday in an email. “They extend their heartfelt gratitude to the jurors for their time and commitment to getting this right. Although they will always have a void left by the loss of their husband and father, they appreciate the verdict as an attempt to make them whole from their loss.”

Attorney Edward Gould of Bangor represented EMMC in the litigation. He called the verdict disappointing.

“We recognize this was a personal tragedy for the Braley family,” he said Tuesday in a phone interview. “The hospital feels the doctors and the nurses all provided him with excellent care.”

Nelson’s attorney, Phillip Coffin III of Portland, said Tuesday in an email that he and his client were “very disappointed in the verdict and a bit surprised by the amount of the award, especially in certain categories of damages.”

The jury awarded a total of $6,711,000 in damages in the following amounts, according to the verdict form:

  1. $11,000 for funeral and burial expenses
  2. $1 million for Braley Sr.’s conscious suffering before his death
  3. $1.2 million in loss of economic support
  4. $4.5 million for loss of companionship and emotional distress

Eight of nine jurors concurred with the verdict, according to the verdict form, which did not require the juror to explain why he or she did not agree with the decision of the majority.

“The case was well tried by all parties, and the Braleys are genuinely nice people, who suffered a tragic loss of a husband and father,” Coffin said in the email. “We truly believe that the medical evidence proved that Mr. Braley died of an unexpected and unpredictable rupture of an intercostal artery and that no test, lab or evaluation could have predicted or prevented what happened.”

The attorney said the jury ignored a unanimous finding of a prelitigation screening panel, required under Maine law in all medical malpractice cases, that actions alleged by Braley Sr.’s family did not cause his death.

The Lee man, who worked as glazier, was injured May 6, 2005 in an all-terrain vehicle rollover accident at Dobsy Lake in Lakeville, according to Flynn and court documents. He suffered several broken ribs, among other injuries, and there was indication of internal bleeding from CT scans ordered by the emergency department physician.  

The doctors caring for Braley Sr. failed to follow up on the indications of internal bleeding including not issuing an order for follow-up X-rays to monitor the internal bleeding, according to the complaint. Over the 36 hours following his admission to EMMC, the extent of the internal bleeding caused one of Braley Sr.’s lungs to collapse. The lack of oxygen precipitated a massive heart attack, from which he died, according to the attorney.

“[His] death may have been avoided with the placement of a chest tube for drainage of accumulating fluid,” Flynn said. “Mr. Braley’s death occurred on his 44th birthday, which was also Mother’s Day, and was witnessed by his wife, children and parents who were present for a birthday-Mother’s Day family celebration.”

The award most likely will be reduced by Superior Court Justice William Anderson, who presided over the trial, the attorneys agreed. Damages for conscious suffering and loss of companionship and emotional distress have been capped by the Legislature. The cap in place at the time of Braley Sr.’s death would apply but attorneys were not sure Tuesday if six years ago it was $300,000 or $400,000.

A decision on whether to appeal the case would not be made until after Anderson issues a final judgment and a total damage award is finalized, according to Gould, the hospital’s attorney.

    $400 thousand isnt very much in todays standards really…not with the way that most businesses are allowed to make 500% profit or get a stimulous package to make up the diffrence.  Society will take that from her in 10 years.
    Its not right to “cap” what one should receive when they sue for this reason.  It demeans the life already lost and this is just alcohol in the wound.. She deserves to get the whole thing.
    I also wish they had more of the story and know what exactly the Dr. did wrong and is he still practicing?

    I”m happy for paula and her family. Knowing them personally I can honestly say that they have been through alot and deserve the settlement. There is more to the story then what BDN has reported so the ppl making the sarcastic and rude comments can step off. Have some respect. RIP Tom.

    Like “ro6otmom” asked…what, exactly did EMMC and the staff and Doctor Nelson do to instigate the death?  Is this protectionism under the law when a physician, working under a hospital corporation does something which appears a malpractice situation and cannot be revealed to the public…especially under the Freedom of Information Act codex?  Did the physician lose his license, get fined, or lost his practice or was this part of the “fine” and punishment guidelines? 

    This is a difficult situation for everyone here to go through.

    That is not how it works-it does not matter whether or not he caused his own injuries; the doctors and nurses have a legal responsibility to care for all patients. A CT scan revealed he may have had internal bleeding and they did not follow up; thus, the mal-practice was negligence and probably incompetence.

    The Maine Board of Licensure in Medicine is responsible for regulating and disciplining physicians. If his license is suspended or revoked I would imagine you would be able to view it on their site because you can do that for nurses on the  Maine State Board of Nursing.

    No it is not part of the fine and punishment-this was between EMMC and the family; the family sued the hospital. The Maine Board of Licensure in Medicine would discipline the physician. EMMC could turn around and sue the physician too.

      “The attorney said the jury ignored a unanimous finding of a prelitigation screening panel, required under Maine law in all medical malpractice cases, that actions alleged by Braley Sr.’s family did not cause his death.” Thankfully, the jury did ignore these finds of the prelitigation screening pane,  which I am willing to bet, consists of a group of doctors that look out for their own best interests when deciding on these potential malpractice suits.  With every suit that goes to trial, there is a substantial increase in their Profession Liability Insurance, an already extremely costly expense.  Also, there is the negative publicity toward doctors and hospitals when a Plaintiff brings such a suit,  especially if the Plaintiff is successful.  Our legislature is out of line capping awards for conscious pain and suffering and companionship.  That judgment is better left to the evaluation by the jury for each individual case.

    The fault was the doctors failed to check on Mr. Braley’s diagnosis of possible internal bleeding by not following up with  X-rays and failed to place a chest tube for drainage of accumalating fluid.  All the fluid buildup caused his lungs to collapse and then this caused a massive heart attack.

    I will tell anyone that if you are planning on having an operation of any kind, take someone to the hospital with you that has knowledge of what is suppose to happen and to make sure you are taken care of properly.  I have first hand knowledge that if you don’t, you may end up worse then before your operation.

    Physicians should follow proper protocol in caring for patients. They knew of the internal bleeding and did not do their job. Yes, medical personnel are busy, but their first job is to care for their patients and not worry about the computer and all the insurance forms.

    EMMC is notorious for neglect. They forced my children to eat indigestible food for over 3 weeks when they were born. My son was allergic to regular formula and needed soy and even after I told them that it took 3 more days before they started feeding them soy formula. My children indurred 3 weeks of being force fed something they could not digest. Their bottoms bleeding from excessive diarrhea. As soon as they switched the formula they started holding down the food and were able to remove the tubes from their noses. The doctor told me it was a coincidence that my son stopped projectile vomiting at the same time we fed him soy. Can you believe that? Statistically speaking that is crazy and because I was taking a class based on statistical analysis I told him so. The same mother and father combo probably produced the same problem.  I removed my children that hospital immediately. Later they told me they would not allow that doctor to practice there again but that is of little condolence. That  was not even the worst one I personally experienced. It was worse when I went into the ER with chest pains and a blood pressure of 220 over 120. They told me to just calm down and sit in the waiting room until they got to me. I was having a bad reaction to some medication I took and anxiety was making it worse. I will never forgot the feeling that I was going to die in this ER why this person chatted away. When I demanded treatement they made me wait longer. Till I “calmed” down. So reckless comments they are not. Even if you personally have not been affected that does not mean it doesn’t happen. Doctors are just not getting the same education they used to I guess. Trying a different formula and helping a patient that has extreme levels of blood pressure should be easy not difficult.

    Lawsuits drive up costs, which means hospitals have to cut staff & cut corners in order to make up the cost. Then when staff gets cut and corners get cut things get missed and quality of care goes down. It’s a vicious cycle. I’m not saying that this wasn’t tragic, but society today has gotten to a point where everything is always someone elses fault. There is no personal responsability anymore. Interesting to that there was a unanimous finding of a prelitigation screening panel of not guilty.

    The doctors failed to follow up on the indications of internal bleeding which directly lead to his death. Simple recommended follow up tests could have prevented his passing. Though there are tort abuses in the health care system, malpractices do occur, and in this case, apparently it did.

    Hospitals have insurance to cover these costs. Lawsuits are just an excuse the insurance companies use to justify their rate increases instead of it being an operating cost paid out the premiums.

    Lawsuits aren’t hurting the insurance industry as they continue to rack up enormous profits.

    Agreed, $400k won’t last long at all and certainly doesn’t compensate for the heartache,but the reason for ‘capping’ is that jury awards were getting out of hand (some bordering on ridiculous) and used to punish the doctors more then compensation for the victim.

    The malpractice insurance premiums were/are out of this world, driving many doctors to other careers, resulting in a shortage nationwide with longer appt. lead times (5 years ago,my primary was paying $127,00 per year for his ins.).   This may also have contributed somewhat to nurse lay-offs, but unlikely.

    Regardless of whether the insurance companies make money or not the hospital still has to pay for the policy and has to pay the rate increase. The very fact that hospitals and doctors have to buy policies is because of frivolous lawsuits. And as for the insurance company making money…Lord forbid a company make a profit. If you don’t want to pay their prices, don’t buy the product.  Who are you to decide what their profit margin should be. Maybe we should place a cap on how much you can earn at an arbitrary number that I decide is enough.

    Yes he received the injuries from a ATV accident but he died becaused the doctors failed to treat him for those injuries  and ignored his bleeding.  Never should have happened!!!!

    I had to pay my lawyer 50% PLUS expenses and they were about another 25% . TRAVEL , PHONE CALLS . COURT FEE FOR HIM ,ECT, they know how to add it up, beleive me ,at $400 to $500 per hr. it doesn’t take long .

    This is what happens when doctors see your insurance and make the decision on how well they will take are of you or in this case not take care of you. too many people get sent home with the phrase ” it doesn’t seem to be this, BUT if things get worse bring them back in the next couple of days.” In translation it means ” i don’t want to deal with it right now so bring he/she back in in a few day so it’s somebody else problem.
     When I was in high school years ago I had a soccer coach who brought her 2 year old son to EMMC because he had a fever and wasn’t feeling well.  So long story short, they sent them home  saying it was just a cold and by the next day it was worse so she was bringing him back in, but he ended up passing away in the back seat before she could get him there. it was scarlett fever which ended up killing him because of  lack of care on their part.

    After a short time into this case, the hospital realized they were going to lose and decided to best absorb the loss and cover the increased premiums, they would lay off nurses yet again….the nurses are always the first line when it comes to cutting operating costs.  Too bad the hosital didn’t realize they are also the FIRST LINE at the patients bedside.  There are other more costly areas in the hospital that could use some trimming.

    So how many nurses will EMMC need to lay off to make up this money?  My sympathies and congratulations go to the Braley family.  While the monetary gain will help, nothing will bring back your loved one.  At the very least, maybe this will keep EMMC from doing the same to someone else.

    Thank you, SmrtyPnts!  People apparently don’t understand that concept (the doctors and nurses have a legal responsibility to care for all patients).  An error and negligence almost cost me my life and I will never risk going to a hospital again.

    If you read it correctly the damages that are capped are the damages for conscious suffering and the damages for emotional distress.  Therefore the family would still get :

    $11,000 for funeral and burial expenses
    $1.2 million in loss of economic support
    $300,000 to $400,00 cap on those two damages

    The total award would be somewhere around $1,500,000.  Nobody can put a monetary value on losing a loved one.  the goal is to try and do whats best to compensate the family for their loss and also keep the healthcare industry healthy so we all can have access to quality care.

    Your reading comprehension is pretty weak.  As the article clearly states, there were several indications that the man was bleeding internally.  The hospital staff never followed up on those indications, while the poor man bled out internally to the point one of his lungs collapsed, which led to the fatal heart attack he suffered.

      My Ma had dizzy spells back in the ’80s, was told she had a tumor behind her right temple and Bangor wanted to do a biopsy.  I begged her to go to Boston, but no.  They removed it completely the same day and she spent the next 11 years slowly sliding downhill. The last time I saw her was in a ret home in Houlton. (A distance away from me)    She was strapped in a wheelchair, snot running down around her mouth and eating plain macaroni with her fingers.   It was the radiation that did it.

    Most docs are good, but when my hip was replaced and metal put in my shoulder, I went to Boston both times……..I will take my chances there.

    This settlement is egregious. The expert panel should have been listened to regarding the medical evidence.

    I wonder if the deceased had life insurance or health insurance? Was he driving around on an ATV in a dangerous manner without those things in place to protect his family and himself? I hope not, because if you own and can afford an ATV but don’t have a life or health insurance policy with two children that would be irresponsible.

    All the hysterics on this wall are ready to demonize anyone who questions the verdict. The jury was probably a group similar to your mindset. It is not disrespectful to the family to question the wisdom of 9 people who made a decision that substantially affects the hospital’s finances and thus costs and care for everyone else. Just because someone died tragically does not mean you can use his death to shout down anyone who disagrees with this.

    this is one reason why health care costs are so high… and why doctors are affriad to diagnose & treat serious issues. for if the treatment & medications don’t work they can be sued for that as well. the man died because he failed to obey the safe operation instructions on his ATV. not just because the doctors failed to help him live. Loss of companionship can happen to anyone at any time. I’m sorry for the families loss, but what was the point of the lawsuit other than monetary gain? If there was a severe injustice then I could understand.
