BANGOR, Maine — A Bangor man police describe as a transient was arrested Tuesday night after an employee at the Family Dollar on State Street reported that a man who appeared intoxicated was eating chips he had not paid for.

When a police officer arrived, Bartley Smith, 42, was indeed eating chips, Sgt. Larry Weber said Wednesday night, citing an arrest report.

When questioned by a police officer, Smith reportedly admitted to consuming the snack food, according to the report. When asked, Smith told the officer he did not have the money to cover the cost, which a store employee said was $5.50.

The officer asked Smith if he also had consumed alcohol, Weber said. Smith reportedly indicated that he had consumed a 22-ounce beer, which along with the theft of the chips violated the conditions of his bail from a prior, unrelated arrest, the report said.

Smith, who was taken to Penobscot County Jail on charges of theft and violating his bail conditions, since has been released on bail, Weber said.
